I'd say some don't offer warranty. The majority do offer it. And for the majority of mobile phones it's 2 years. I know only iPhone with 1 year warranty.

You have misunderstood. I am saying they are not obliged if they don't offer a warranty. Some people seem to think that they can contact the manufacturer of any product to get it fixed under warranty but they can't unless the manufacturer offers such a warranty. They are not obligated to offer a warranty although some do. The point is it is the retailer who is legally bound to have things fixed things under warranty.

But Samsung DO offer a warranty... http://www.samsung.com/uk/support/warranty/warrantyInformation.do?page=POLICY.WARRANTY

So we can discuss the ifs and buts that apply in the case where a manufacturer doesn't offer a warranty, but in this case we know that they do offer one, so why bother?

A manufacturer's warranty is an entirely separate contract to that of the purchase contract between the consumer and the retailer. The retailer need not be bound by any warranty offered by the manufacturer that exceeds their own terms and that which is dictated by prevailing legislation (namely SOGA).

I didn't know they offered one soz.

I'd still be pushing CPW do sort it though.

In an ideal world so would I. My expectation is that the person I buy something from will act responsibly to resolve any issues I have in a timely and hassle-free manner but as far as high-end consumer electronics go, the manufacturers warranty is quite often the lesser of two evils.

Very true. I just hate it when the retailer gets away with it!

Hi, just ask them for proof of physical damage, if they cannot show you some then your entitled to a replacement , if they can show you proof then you are stuffed.

From their point of view, if there is physical damage then why should they repair/replace it, that's what insurance is for.

They should be able to provide photographic evidence as proof.

They always do, it will be in the repair bag with the phone. Also, just a point that CPW only get paid for successful repairs so there is no need for them to lie.

OP, just ask for the engineers report and go from there.

That is hardly a fact that conclusively proves that Apollos can always survive a drop.

Lots of people survive car accidents every year, lots of people don't. By the same principle a phone can be dropped ten times and survive unscathed. Another phone of the same model can be dropped once and be permanently damaged.

Even if it were correct, this would be a good reason for them to fob the customers off if they cannot repair or find it far too difficult. However, I think it's not the case.

There probably is no need for CPW to lie. However, there are many reasons for an engineer to lie. If they are overloaded with the broken phones, an inspection with "damaged by the user beyond repair" result is the easiest option for them.
