Ebay phoned me up saying there coming round to collect some money

    Not all of us are, Soo. Just the OP and a few people who seem to be armchair vigilantes. Most people are concentrating on what you can and can't do with debt collectors etc. which I don't know enough about to offer any sound advice except "pay up".

    better still quote "you are trespassing on my property, if you do not leave I will use sufficient force as necessary to remove you from my premises"...then get hold of them by the ear and lead them off your land...no it won't solve your problem but it will give you immense satisfaction.

    bottom line: selling on ebay is risky, even if you take precautions ( a bit like sex really, except without the awkward small talk afterwards!)

    OP I'm sorry you got burned, I'd be mad at your brother if I were you! I don't sell on ebay anymore due to problems such as this.

    Regarding the debt collectors, they are persistent and its best paying a small amount each time to clear off the debt so it doesnt seem such a big amount.

    to the posters unsure over whether it can affect your credit rating: I *believe* that having a negative paypal balance WON'T affect your CR, but not paying the debt collectors CAN if you enter into a payment plan and don't stick to it, or don't pay at all.

    Paypal can only take someone to court in The Grand Duchy of Luxembourg, where they went to avoid UK legislation and UK taxation.

    Paypal are registered with the FSA and have a registered UK address (in Richmond) so of course they can take you to court.

    Dave unlike you i can admit if I made a mistake. But my points still stand that Paypal can still take someone to court in the UK, There is nothing stopping them legally. That was my main point which you seem to not have a reply for.

    Can you find me any information that says a company with a UK address is unable to take anyone to court? I await with baited breath.

    I would tell the buyer, that as he claims its not been delivered you are going to start a royal mail claim, and they will investigate, so you can get a refund of partial costs, and remind buyer that if royal mail find it was delivered (ie postman recalls delivering it for example) then they would be within their rights to involve the police, as they would have committed fraud.

    Given that from past experience you don't like facts to get in the way of an argument, if we take your anti Paypal propaganda as fact and that they are wholly based in Luxembourg, then your statement implies that only companies/people in other countries can take out legal action in the country they are based, this is inaccurate and misleading to the person in the opening post.

    Or alternatively you could believe the buyer and not risk a neg and low stars for insinuating they are committing fraud when the seller sent it using an unsafe, uninsured method of delivery.

    I am trying to picture a postman who will be willing to stand up in court and swear an oath that the laptop from the OP was definitely delivered to the buyer.

    Even assuming a postman would be willing to do that in his own time how do they know what was in a package and who sent it?

    Unless OP can show definitely with tracking that an item was delivered, which he can't as he admits the wrong postage service was used then I can't see a court agreeing that there is any fraud involved here.
