Ebay phoned me up saying there coming round to collect some money

Hello I hope I have posted this in the correct place. At present my Ebay account is negative £200, this is because I sold a laptop and my dopey brother posted it by standard parcels (aka no tracking). To cut A long story short the buyer claims in never arrived and did a charge back through ebay.
Today at 11am Ebay phone me up asking for a £200 payment to bring my account back into the green, I said I'm not paying I posted it ect and the buyer has got a free laptop, the ebay guy said I broke the t&c,s by not posting it recorded.
He said If i dont pay it will be passed to a collection agency who will come to my house and collect the money. Can they do that? I'm sure they cant just turn up an my house and demand money can they?
If I have to pay it back I'll just pay a fiver a week surely they cant make me pay it all back at once. its made me:mad:

Yes, you are responsible. You didnt post it securely, you do not know whether the buyer is lying or not, but you have to prove delivery, trackable on line.
It's a debt, so if not paid, yes the debt collectors will come knocking.0 -

Doesn't matter if he did or not, also recorded is not enough insurance for this item.
It is up to the seller to ensure the goods arrive, and this needs to be proven via tracking. Therefore the postage option on the auction should have been an appropriate service, which could have been charged for on the P&P element. Postage options which are not trackable should never have been offered, the buyer should not be given the choice.0 -
oh yes they can do that, same thing happened to me for £75 (right before christmas!) and I'd spend £15 sending it by normal delivery (becuase they didnt want to pay the extra to have it recorded - now I know why!) so I was out of pocket for £90, plus the cost of the item originally.
basically, unless you can prove it has been DELIVERED, you are liable for the money. It absolutely stinks, people talk about getting a certificate of postage, but that doesn't hold up to paypal or ebay, you have to prove its been delivered not just that it's been sent.
so yes, you will have to pay it back - and more than likely the buyer does have it - I honestly think people do it on purpose so that they can scam the money back and have the item too.
I messed the debt people around with mine though, as I have a young child (even though I was working more hours at the time) I "pleaded" poverty and gave the jammy gits a fiver a month. they must have spent more money phoning me asking me to increase my payments than I ended up paying them, and half the time when they rang I'd say oh hang on a sec and went off to play with my son and his toys, leaving them listening to us til they got bored and hung up.0 -

Actually even if you can prove it's delivered you're still liable. I sold a phone a few years ago, sent it recorded, royal mail website said it had arrived, and paypal still found in favour of the buyer when he claimed not the have received it despite me providing all the evidence.
I fought it and fought it and just went round in circles. It ended up with a DCA and eventually I paid it just to get them off my back (I was getting about 6 phone calls a day). I have never used ebay or paypal since. IMO you're completely gambling your money/goods as a seller on ebay, relying on the good will of the buyer not to pull a fast one.
That actually made me laugh out loud. Brilliant.half the time when they rang I'd say oh hang on a sec and went off to play with my son and his toys, leaving them listening to us til they got bored and hung up.

You are liable unfortuntely.
Dont forget, if you dont pay it, you will end up with a default on your credit file, major mistake.
No credit, mortgage or anything like it for 6 years...do yu really want that.make the most of it, we are only here for the weekend.

They will pass the details to a debt collecting agency, so on top you may well have further fees.
You would have agreed to cover losses when you signed up.
It may be best to try & come to an agreement to pay sooner rather than later.
Special delivery or a courier with additional insurance is how an expensive item, over £46 should be posted. Under that amount then COP is OK, as you can claim for that loss from RM. (As long as the item posted is covered with COP, details are on their website).
If you post something for £75 & rely on COP then RM will often refuse to cover the £46 as the service used & paid for wasn't appropriate.0 -
The debt collectors that paypal use are not very nice and they use borderline scare tactics to get their money back, also of course as has already been mentioned th emoment they start sending letters and paying visits to your home the debt goes up. It really really does pay to make every effort to raise the money to pay off your debt before ti goes too far.
Unfortunately without proof of delivery tracked online you have no argument with ebay, your argument appears to be with your brother.
