    My take - judgement free I hope.

    If you are signed off work then that means you are (theoretically) unfit for work.
    I would be surprised if a new employer took you on in this situation, however some may do so.
    If I was your current employer and found out that you were working for someone else while still technically contracted to me, I would then be after you for some sort of reparation.

    It may be that the stress of your current job means that you genuinely cannot work for them, and for which a GP will legitimately sign you off. If this just happened to be a period of time up to the end of your employment when you are lucky enough to start a new job then I think that would be fine.

    i never did get signed off in the end

    I went to the office today and still saying they never got no emails and i even sent them again yesterday from a different email address.

    Well i took a copy of the emails to show them anyway and i said i might aswell leave as there going to punish me for not turning up for my check in.

    They said they will have to wait until the boss returns to get a final answer from them but i dont want this to drag on any longer so i have wrote a letter to leave the company anyway and will post it 2 them 2mo

    After i walked out there office i walked into another one and picked up new work gear and starting on the 2nd jan.

    Really pleased that it has worked out ... in a roundabout sort of way!

    Sometimes you are better just to put things behind you and move on, and sounds like you have done that.

    Was anything said about the fees? If there is any comeback on that get in touch with the relevant clause in your contract and will do what I can to help.

    i had to sign a statment months ago saying if i leave i pay back the company. so no looks like i will have to pay them back. but then again they owe me money so they will deduct it from there.

    Did you sign it at the beginning of your employment? If not, you may not be liable for any fees incurred before that time, as consideration cannot be past.

    i started in 6th feb this yr and signed a contract then company got bought over and changed names on 1st june. never got a new contract with company name and then they sent us a form to sign on the 7th june

    In that case, assuming that nothing is mentioned in your original contract, then any training fees incurred by the company between Feb and the beginning of June cannot be reclaimed from you, as you cannot sign in retrospect.

    A colleague and I had this problem in previous employment. As soon as we mentioned the fact that a contract cannot be retrospective, they backed off.

    If the company try to take too much money from your final salary then this will be an unlawful deduction in earnings, and may be challenged at an Employment Tribunal (it rarely reaches this stage, with the employer settling beforehand).

  • Glad to hear you're OK fairmorn. If you want to quit there isn't much they can do about it. You can work anywhere you damn well please. If they do try to make deductions from wages owed for any reason, query it. I don't THINK they can make a deduction in lieu of notice.
