Sorry - really don't know the answer. Hopefully someone will be along soon who can help. One thought is that if your new job would be with an agency, they surely would keep it open.

i would even think about staying with this company if i got transfered to another oil rig but i think they will go mental at me if i tel them that now as they only open on wednesday and am due away on thursday0

am not ill but its not hard to get signed off by a doctor
also i seriously cant go back and work for the company. there is 2 much behind it and am not willing to go into detail why am sorry.0 -
So you're lying so your Dr and employer so you can get paid without actually having to work, and now you want advice on how to defraud them further by not paying back the costs of your training?

If you are not ill then you shouldnt get your doctor to sign you off. For one its being dishonest and second it will be on your employment record.Weight Loss - 102lb0

I wouldn't be dishonest and sign off sick when you're really not. By the sounds of it you'd just end up worrying about being caught. Perhaps your new employer (or the agency) would be willing to pay your training costs if your employer demands. Either that or check your contract and tell them to go whistle for it or just head down, butt up until you can legitimately leave. It sounds like absolute torture so I'm assuming you are being bullied but sometimes knowing that there is a time limit (promising yourself to be out Feb 6) can make it bearable in the short term.
Your employer has a duty of care when it comes to your welfare (especially if you are living in accommodation provided by them). It probably sounds daft - keep in mind you haven't told us your exact circumstances - but is there someone higher up in the company you could ask for help? If they've paid for specialist training they may be loathe to lose you and there might be an option to move you elsewhere.If you think reality makes sense, you're just not paying attention!0 -

Okay, here's a very blunt reply.

Yes.
The agency may also deal with your current company - especially if you are working in a specialist community where everyone knows each other and transfers between companies. You might even be dobbed in by someone.
You may also be implicating your doctor in fraud - from memory there used to be a warning on sick notes that you could be liable for prosecution if you were shown to be lying (and going straight to work for another company would be pretty convincing proof). Unless you were up front and said it was mental stress from this particular working environment, because at the moment it sounds like you wish to claim a physical injury you don't actually have.
If you are asking "Can I get caught?" the answer is yes. Easily. The question you really seem to be asking is "Am I willing to be a cheat given the circumstances?" and that's something only you and your conscience can answer.
Sorry to be tough, you sound like you're pretty much at wits end. I had trouble coping with bullying because I didn't feel I had anywhere safe I could retreat to. What a rotten Christmas for you.
