getting signed of your work

i work for a company at the moment but i honestly do hate it and i cant leave until 6th feb as they gave us it in writing if we leave within our 1st yr we will have to pay back our training

but i only need to work two more trips with them then i can leave but i honestly cant take workin with them no more.

I can get signed off from the doctor and also i have another company chasing me to work for them but if i keep turning them down i wont get another chance.

here is the main question

If i get signed off and go work for this other company in the mean time can my origanal company find out in anyway that am working else where?

    Yes, they might. Your new company might contact them for a P45 or P46 (forget which is which, after a glass of wine).

    It seems that the main thing stopping you leaving is the fear of paying back your training. Can you post more about this? Most of these sort of clauses are in fact unenforceable. Even if enforceable, the clause has to be reasonable.

    Should you start new employment whilst signed off on medical grounds then you would not be covered by your new employers insurance, and therefore the potential new employer would be very unwise to employ you at that time.

    I have been in your position and know how horrid it is. However, I would question starting work whilst officially signed off as sick on ethical grounds. This may also be questioned by your new employer.

    Would it not be better to get signed off sick, take the time off and resign whilst you are off sick. Then you can start the new position with a clean slate, and no possibility of past skeletons coming back to haunt you.

    When you say you can't leave until 6 Feb do you mean you can't hand in your notice on 6 Feb (and leave 6 March if you are on 1 month's notice)? If you can actually leave on 6 Feb then you could hand in your notice 6 Jan. What about any leave owing as well? Sorry if stating obvious and you have thought of all this but worth putting just in case you haven't!

  • we work 2 weeks on 2 weeks off and just been at home for about 3 months on full pay and my last trip was the 1st one since returning and i thought it would of been different but its still the same.

    i can leave on the 6th feb so means i can hand my notice in 6th jan.

    but if i go on the sick for two months it means i only get 50%

    there is alot more behind it for the reason i m leaving but wont bore you all with the reason.

    If you accepted the new job on Boxing Day I would think that anyone who is chasing you to work for them will understand that you can't hand in your notice until 6th January. Also, not knowing much about the job, would you want to anyway - would your new employer want to write for references, etc. which can take quite a long time? If you do hand in your notice then you only have a couple of weeks to go before you can get that doctor's certificate!

    its going to be working for a agency work anyway.

    does that still make a difference. they dont need any refs from me or anything just me to turn up for doing the job.

    I don't know - probably best to look into jobbingmusician's reply earlier. Sorry can't be more helpful. Other than that, can't you talk to your present employer - if you've been off sick for a couple of months (sorry if I got this wrong but that's how it read in one of your posts) then they might be willing to "let you go" without repayment.

    no no i wasnt off sick

    the whole workforce was off due to upgrades and they went over there time scale by quite a bit

    thing is can they make me pay it back tho?

    also the main reseaon i dont want to go back is they took away my bonus cause i missed a training course cause i missed the train due to taxi turning up late
