    You are 100% correct, and succinctly put !

    The origin of the thread was about a "" Blitz carried out on Disabled Parking Cheats by Supermarkets "". As is always the case the thread is dragged sideways into different but adjacent areas of interest to a particular poster.

    For myself the title of the thread "" Blitz on Disabled Parking Cheats by Supermarkets "" each person may see that differently, most posters in the thread have seen it in the wide and general terms of DLA / disabled.

    I saw it in the narrower and specific terms of the Blue BB scheme itself, and its misuse. The BB scheme is there to allow people with severe mobility [ not the whole wide range of disability ] problems, who have difficulty using public transport, to park close to where they need to go. That's why the general benchmark qualifier is the higher rate of the Mobility Component of DLA.

    Much of the current BB misuse will hopefully be addressed this year / next year. A roadmap has already been agreed but the new BB itself will be issued form Sept 2011.

    - NHS assessors not GP will decide eligibility and independent assessments when eligibility is in doubt
    - new guidance to LA's to stop the fiddlers / forgers / and national enforcement
    - implementing a new national anti fraud BB design from Sept 2011
    - power to employ local authority-authorised officers with a power to confiscate, on-the-spot, badges that have been cancelled or misused
    - amending existing legislation to clarify wrongful use of a badge and the powers to inspect badges

    Im due to renew in September, do you have a link to the new BB regs?

    Its the timing im intrested in, will it take longer to renew I wonder?

    A quick google * and * and * and * and * I can however assure you that the BB issue itself should take place as normal with your LA, even after the changes they will continue to be issued by your local LA as part of the ' localism agenda '.

    All this assumes the dot.gov will be able to roll it out on time, the consultation has been going on for over 15 months, updated info from dot.gov is not due out untill the end of this month. Here's a one from Surrey, and one from our claymore weilding colleagues, and one form Derbyshire

    :eek:i hold my hands up and say i am someone who parks in one of these - for 2 reasons,

    firstly, i have limmited mobility myself, am in sever pain all of the time but have been waiting a year to get a dla apppeal as there is such a long waiting list. i see i should be awarded this so shoud be entitlfed to park here, and it is my only idependence nipping out to the shop for 10 mins.


    2ndly my elderbly mother is 72 and her mobility has gone downhill severly over the past 6 months - i keep asking her to get a disability scooter but she is too proud and now if i take her out for a drive she won;t even get out and waits in the car.

    my pooint here is if the beuracrary wasn;t so difficult and long winded i hope i woudl be one of those that would be warranted one anyway as i walk with a stick and am only 40 so we have to be careful not to judge people.

    i am afraid i also park in parent and child whatveer is nearesst.

    i went somewhere where they offer temporary blue badges which i think is a good idea as sometimes like myself when you first have an injnury in theory you like to think you will get better in a few weeks - unfortunfately not so for me.

    so i hold my hands up - but i think with good reason.

    dla/esa bad enough i a,m sstill trying to face the bb forms.

    Others may take a different view. I would report you without any compunction whatsoever.

    Apply for the BB for yourself or your mother, you can get a BB [ yourself or your mother ] without DLA at the moment. Current registered disabled customers who don't have a BB have no rights to park in a BB bay. Even the current non-supermarket rules have a sanction against bona fide registered organisations issued with a Blue Badge where they can be fined up to £1000. The current ' 3 relevant convictions ' rule means you even if you are a registered BB holder you can have you badge revoked immediately without appeal, and the dot.gov are considering a new [ after Sept ] rule to impose a hefty fine along with badge revocation.

    You morledge142, as I'm sure you are aware are not an exception just one more individual who wants to be a special interest group.

    Clearly you need help and may be entitled to help why don't you start a new thread asking for help and post your details including an update on [ we don't need to know the outcome of your bankruptcy hearing ] Since your car crash in Feb 2010 you walk slowly with sticks / how did you get on with your DLA appeal in may 2011 ? / you are already a carer to your son [ same accident ] he was awarded MRC / LRM. / etc


    Special Interest Group

    Anyone in any vehicle without a BB / women in who are now so disabled [ because they have children ] they cant even park their car without equivalent rights / Catholics / alcoholics with gout / policemen stuck for a quick sandwich / people who walk with sticks and are turned down for DLA / etc.

    I'm ambivalent to your reasons for using dissabled bays (but clearly you wouldn't use double yellow parking so are only doing so in private car parks because you know you can get away with it). However your reason (or lack there of) for using parent child spaces is just laziness and ignorance. Even if you had a BB you should not park in parent and child spaces just as we would not expect any parent to think it's ok to use disabled spaces ever yet alone just because they're closest. There's no excuse for that what so ever.

    i do admit it is laziness as is my use of double/yellow lines where i think i might get away with it as i sometimes canit face walking to pay meter in a normal car park if i think it is a quick nip.

    as i myself have driven around towns numerous times looking for a space and gone home without.

    i may be nieve but i did not realise it was an offense thought it was something the supervmarkets should but were not inforcing,.

    as with car parks and yellow lines it is one of those things i am sure most people have done "you take your chance at your own risk" but when you weigh up a deterrant does help and the higher that is and more publicised that would stop people doing this, me included.

    as for my other stuff going on thanks for your interest richie.
    bankdrupcy went ahead ok and still waiting for tribunal date for dla so these things take so long to process it is frustrating having to wait so long and it is out of my control.

    my lack of applying for bb is my own laziness but a deterrant or kick up !!! may be just what i need to get on with applying.
  • I've just looked up my reference to my sentence in #75 above "" dot.gov are considering a new [ after Sept ] rule to impose a hefty fine along with badge revocation "" here is what Scotland proposes !

    - to increase the maximum fine for misuse of the badge from £1,000 to £2,500
    - use only the same definition of 'unable to walk' as the DWP one for HRM component of the DLA
    - extend the eligibility to severely disabled service personnel and war veterans.
    - extend the eligibility criteria to people with severe forms of autistic spectrum disorder and very advanced forms of dementia
    - use independent medical / mobility Assessments not GP's
    - move the photograph of the badge holder from the reverse of the badge to the front of the badge
    - allow local authorities to share badge holder data with each other.
    - introduce a fixed penalty for those that fail to return an expired badge
    - include a vehicle registration number on the Organisational Badge
    - remove permission to park on double yellow lines.
    - introduce a time limit for parking on single yellow lines

    You've misunderstood the thread, supermarkets are private land, they don't .. .. at the moment have a national agreement to enforce BB rules.

    While you are waiting for your DLA appeal, put an application for a BB in, I've no idea if you will succeed but its a given if you don't get one now you certainly won't later this year.

    I am photo exempt on my BB,I also have more than one vehicle so more battles to fight:mad:

    I'm not interested why you are currently exempt a photograph, unless you are classed as terminal, or perhaps you live in a very ' countryfied ' area where it's done via email, but its not because you don't get DLA, I've no idea why. The proposal to have the BB showing a vehicle registration number is one I subscribe to, in fact essential to weed out the fiddlers. Most of the BB holders are DLA recipients, and have a fixed motability or otherwise vehicle, but not all. Some, a minority of BB holders do not own no fixed vehicle, and the law already exists under the three strike rule ' to weed the offenders out and revoke & fine the BB holder. If you have two vehicles maybe after September[ish] you will need two badges - the spare one for your motorised caravan. There is no reason why one disabled ' mobility ' person should not have more than one vehicle, many of the non-BB general community do .. .. that's the raison d'être behind the legislation. Their straight cucumbers rule was a stupid rule, this BB freedom of movement rule was a gud~n !
