I think I (and people like me) as someone who has gone through this for the first time, would like to know exactly what legal paragraphs, sections of Acts that one can use in the unlikely event one has to state them in court. In short, acting as the solicitor yourself (with all the knowledge a solicitor has in this specific area of law) confident in the knowledge that your arguments can kick them back under the stone from where they came.
:rotfl: Definitely!
To spell out the law the way some fundementalists can recite their holy book, there are two ways.
The first is to go read every section word for word and this would be like looking for a needle in a haystack; your brain will dry out and your eyes will give in, like bedtime reading! **yawn**
The other is to catch it when it comes to you first! You're reading a forum and suddenly one of the users has posted the relevant data. Naturally you paste it on a search engine to make 100% certain you will get the result and from the government website so there can be no ambiguity - then save it somewhere.
I used to do this but after time I became familair with the rule itself and no longer needed the law code. To be honest, if you throw the book at them as you wish to do, they will only send back a letter of rejection "of your appeal" which will be in the form of a template letter.0 -
dear people
i know im not different but ive had the exact same car park fine except i parked" longer than the period paid for" (i see this as being different due to the fact i cant use the excuse 'inadequate signs'...though the parking bays where small i.e. they where a square of 1.5m by 1.5m (approx) and im sure i can find other reasons why i should get away with it. but got I need to be told individually what to do for piece of mind.
im sorry if you keep telling people to ignore, i will ignore until told other wise but I am $#iting it!0 -

You have not had a FINE! Stop thinking they bear some sort of authority !!!!!!!
Why would you be worried about a scam, even if they do try a handful of Small Claims they are very unlikely to win any if the cases are defended.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

i think the idea of court is scary, technically i am in the wrong.
but the car is in my fathers name...so hopefully if it does go far my dad is going to claim it wasnt him, and not tell them who it was...though not sure on the legallity of this0 -

Then read the sticky threads, see the preview pics of the letter-chain and watch the Watchdog link. You will know your father is correct.
I know you are worried but - it's simple - of course you don't pay a scammer, you are not 'in the wrong' and it's NOT a 'FiNE'!
Read some other threads, there's so much info about private parking companies (PPCs). Ignore their bogus 'tickets' and be ready to laugh at and file away the 'scary letters' that will follow this bogus PCN. See the important top thread 'PPC letters' for preview pics of the letter-chains and go to the thread called 'Welcome, please read before posting' for the must-see Watchdog paper aeroplane youtube link:
http://forums.moneysavingexpert.com/...play.php?f=163
Most of us here have ignored these fake PCNs, whether from a supermarket or McDonalds car parks or where-ever. My fake PCN ticket 3 years ago was for ov erstaying - it's not a crime and a Small Claims Court, if it comes to that, is not a criminal Court!
Basically any 'ticket' that calls itself a 'parking charge notice' is a fake; real PCNs are called 'penalty charge notices'. It's simple to tell the difference even though some of the fakes look legit and they may have a photo of your car on (big wow!) and are followed by scary letters, it doesn't make them any more enforceable than, say, a made-up £50 'charge' from me, for anyone reading this reply.
HTH now calm down and do some reading of the threads on that link, starting with 'PPC letters' and 'welcome...etc.' with the Watchdog link.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Earlier on Friday (5th) I was having a hot chocolate at a nice trendy coffee house which to my delight was full of females: old ones, young ones, big ones, small ones, foreign ones, all kinds!
Except I was editing on here from my laptop at the time. All of this was happening whilst my own car was in the local Tesco earning its next Highview invoice probably set to land on the doormat next Thursday, just before I stick it back in the letterbox so that it returns to the sender via Northern Ireland. The point is this: I was addressing Coupon-mad at the time - looking at these women in the coffee house, I thought "any one of these could be Coupon - apart from the fact she is Sussex-based". The fact is that if I were a PPC-puppet and I knew I was about to stick a ticket onto her car - no matter which of the ladies she may have been, once it became apparent that this is her walking in this direction, I think I'd be shaking with fear from the mouthful I'd be about to get. No way the monkey can defend himself against her!
Technically, you are NOT in the wrong. Well, only slightly maybe. That "slightly" is that you as the driver would owe the landowner for his losses, but this ranges somewhere between £1 and ZERO. What you were given was an arbitrary penalty which is illegal within Contract Law. Now that the issue at hand is this invented sum by your antagonist, the actual "breach of contract" is no longer relevant. So however your enemy can deduce that the amount you owe him is what he says, he can calculate and break down the costs to satisfy the judge in County Court before you are ordered to pay. Prior to his taking you to court, you owe nothing to anybody regardless how many new parties emerge and tell you that your new bill is now £XXX-stupid. The PPC/debt collector in turn will NOT go to court because they know you have done nothing to accumulate some a huge sum. Check mate.0 -

I will give Perky and Firebird20 a clue about me. I was in the crowd at Brighton's first win in the Championship today. I was waving a flag. So pick me out on the Football League Show later then come down to Sunny West Sussex and put a fake PCN on my car...:p:rotfl:PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You said Sussex was big! I knew that, so big they had to cut it into West and East. We now know that you are stationed west!
In the end, we'll catch you with a glass (gotcha!) and every PPC will get back what they have lost through wasted envelopes and tickets!
Seriously - congrats on Brighton's victory. Is the clip of you and the flag on Youtube?0 -
Just seen the highlights. So you were the one waving the flag! Now every PPC knows where to go! I couldn't help noticing that there were a few more waving flags too. In fact there were more flags being waved than people you can squeeze into Barcelona's stadium! Are you sure the Doncaster fans weren't waving Brighton flags themselves? AMEX is lovely.0
