Hi guys,
Whytes have replied to my letter which kindly informed them of address change and my intentions of basically not paying. The reply stated that the dispute will have to be with TCP but until TCP send confirmation telling them not to collect the amount they will still pursue.
Has anyone encountered this situation before? Is this also just part of the process and can anyone send me some advice pleeease? Do i still ignore?
I dont know what to do!
Kind Regards
Yes you still ignore. Whytes can only send letters, once they know your not paying they will stop. They can not do anything else except ask!0 -
I dont know what to do!
Have no worries, if it helps, I too am on the trail with Whyte&Co. for an incident dating back to August. This means I am discovering their letter chain and I get the impression that my most recent is likely ro be the last. It says:
WARNING OF FURTHER RECOVERY ACTION
As you have not responded blah-blah-blah, we are passing your papers to Debt Recovery officers for further action. This letter gives you a final FIVE DAYS blah-blah-blah...
Firstly, who are these supposed "debt recovery officers"? Whyte&Co purports to be a "debt recovery service" itself. So these officers, are they likely to knock on the door? They'll get a disappointing reception given that I have moved!!!! One such reason I haven't been here the past weeks. Even this letter was dated 16 December so those five days had already lapsed by the time I collected the mail today. The car has also been scrapped and I have a new car and a new address! DVLA will be told in the fullness of time.
Nix, unlike you, I am experienced as I often achieve these supposed "charges". My advice to you is no matter what level of negotiation you are at, whatever messages you get from Whyte&Co, you are free to stop in your tracks and ignore everything as there is NO WAY they can take you to court over a private parking issue. With me they seek £92 - totally unjustified since my action of not buying a ticket cost them £1 - that is to say £1 I could have had refunded given this is their own promise as I shopped in the store, in other words their losses are £0.00 + 0% tax, 0% VAT, 0% tax on VAT = £0.00 as on 24 December 2011.
Ignore them and forget them.0 -

Bear in mind that as debt collection agencies have no more power than you or I to enforce debts one presumes that what Whytes mean by "recovery action" actually equates to the use of oversize fonts, red ink and scary capitals.
Remember than unless you (or your wife actually) have received formal notice under the terms of the Law of Property Act 1925 that TCP (there's a decent mouthwash for you!) have sold or otherwise assigned the so-called debt to Whyte's then Whyte's are simply whistling in the dark and are powerless.
Be very carefull though. Whyte's next move will be to shout and scream and stamp their feet.
I like the way they call themselves "Whyte & Co. Civil Enforcement"...Enforcing what exactly?...:rotfl:0 -

Their egos when someone falls for it !Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
The reply stated that the dispute will have to be with TCP but until TCP send confirmation telling them not to collect the amount they will still pursue.
Doesn't that break the OFT rules for debt collectors, that if a "debt" is in dispute the debt collectors have to pass the file back to where they got it from?0 -
These people dont do rules and all you get by writing silly letters to them is more harassment as you are now a live hook and starting to "play the game"Hi, we’ve had to remove your signature. Hi everyone, my first contribution! I received a letter from Whyte & Co, following a Parking Charge Notice from the Asda Car Park in Fleetwood, via Town & City Parking. It is possibly one of the most laughable documents I have ever read. Worse than those emails you get where you are being left $18,000,000 in someones will. It's the typing and other errors that make it amusing. It is supposed to be asking for £82.00 in five days or recovery action will be instigated. What it actually asks for is 82 something or others, instead of a £ sign they have screwed up and used a character that does not even exist on a keyboard. Such is there attention to details that one line reads "Alleged Contravention: Unknown Unknown * asda"
What is it that is unknown then? When I find what character they have used instead of a £ sign I am going to print 82 of them incase they get around to taking me to court for trespass. Or I could just have a couple of quid in my back pocket ready to give them as that is what I would expect an extra hours parking should really cost.
Even funnier is their website though, if you avoid reading all the twiddle and just look at the pictures of them and their offices you could be led to believe they are a real slick operation. Until that is you realise 5 seconds later that they are all stock corporate library images. If you want a really good laugh compare the image they present with the reality of their real office location. I was born a mile from their office address and I can assure you there is nobody walking around Swanley that looks like them. Just Google their postcode and go to Street View to see what I mean. You will be able to see where they really work. Personally I am going to wait it out completely ignore them and see how long it takes them to get bored. Just to reassure anyone worried about their threats they can't achieve anything without a court order, and what are they going to take me to court for, trespass? Financial loss? I don't think so it's a free car park. £2.00 max for an hour.0
