Yep, just ignore Whytes' letters as nothing will happen, no CCJ, no bailiff, nothing.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Bearing in mind my partner is the registered keeper of the car and she wasn't driving it that day.
Well this morning we received a letter from Whyte & Co debt recovery, Swanley telling us that unless we paid the £82.00 within 5 days recovery action will be instigated.
Now firstly do you think we should just write to TCP and let them know the owner wasn't driving or shall we just ignore the whole lot?
We've dealt with debt collection agencies before for 'real' debts and had to deal with a bailiff before which wasn't pleasant!
Hi
Worry not, I had a total of 4 letters from Whyte & Co with final, final final warnings and last opportunities to pay the £82.00 and I ignored them all. Finally, 6 months after the non offence took place, they appear to have given up. Not had any correspondence now for 2 months.0 -
Thanks for the reassurance everyone. I'm going to sit it out and give them nothing

Thats the spirit! Soon you will be advising other potential victims of PPC scammers to ignore their nasty threatmail based on your experience. Spread the word and bring this pondlife down!Still waiting for Parking Eye to send the court summons! Make my day!0

As a ex employee of whyte & Co I absolutely confirm that they or any other debt collection company cannot enforce to collect these debts. They send 3 letters and then stop dealing with the matter altogether. Do not waste your time phoning their call centre on a premium rate number to be told lies about what they can do if you do not pay.
The only parking debt they can enforce on are distress warrants issued by TEC.0 -

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
My husband received a Euro Carparks PCN letter stating a ticket was issued and not paid. No ticket was ever present on the car. Also despite him being the Registered Keeper he was not driving the car. After a few letters from Roxburghe Debt Collectors he replied stating he was not the driver. They have now demanded he tell them who was driving and also that he can be held responsible for the fine as he was the RK. We don't want our Credit rating affected. He is keen to pay the now £108. I am not as I have been reading this forum for the last few months but am obviously very nervous from the threatening letters we have received. Will they pursue us now because we replied? Should we just offer to pay the initial £1 parking ticket charge? Or should I keep the faith and ignore all correspondance from now on as constantly advised on here? What legal leg have we got to stand on? Many Thanks0

Roxburghe are a bunch of numpties and cannot demand you notify them of who was driving and they are lying stating that as you are the RK you will be responsible, this is even confirmed in guidelines from the BPA
I have had dealings with them on behalf of one of our company car drivers and informed them that if they state anything similar to that to us we would inform the police and other authorities.
They ran a mile and caved in immediately. As I am sure others will state just continue to ignore.0 -
Relax. Their templated threats are pure lies. I bet the RK liability crap talks about civil procedure rules and all that sort of thing. They conveniently forget to mention those rules don't even apply to small claims court. We've seen that letter umpteen times. Feel free to send it to your local trading standards.
Euro Car Parks have never ever taken anyone to court anyway. It's not you that doesn't have a legal leg to stand on - it's them.
Carry on ignoring.0 -
