Reply of bog standard letter offering the 20% discount. Hate thinking of giving up but not sure of legal stuff. I'm totally confused how they can state something is included in your order on an invoice in black and white then just not supply it??

Avon will lose a lot of customers now, after this i will not be shopping with them again.

This is the e-mail I got from them today

Further to your recent email, I can advise that after being informed that there was an issue on our website we immediately arranged for an update to our system and this was processed on Thursday 14th December. We can confirm that all personal data on your order history page in relation to your order is secure.

This page displayed the billing name and address and ship to name and address plus the contents of your order for your reference. It did not display any payment details.

We again thank you for bringing this to our attention.

Further to your recent email the contents of which have been noted.

We regret that you are unhappy with the way we have explained the bubble bath error to you. However, we do not believe that a valid contract has been entered into as you have not given adequate consideration and you were aware that it was not our intention to supply this item free without an associated purchase. This was a genuine error on our part and we now consider this matter closed.

  • Don't give up on them yet, keep at it. See my further correspondance below further to my earlier posts.

    Dear Mr Shave,

Thank you for your recent email.

    I replied with....

    Angela,

Unfortunately I do not agree that this matter is closed and shall therefore be pursuing it further.

I refute the comments that suggest I knew this was an error, clearly I would not pay £5.50 for the delivery of your promotional material. Futhermore I refer you to your own terms and conditions posted on your website which state the following:

"The debit or credit card details you give to us will be validated before your order can be accepted. Once this is done, we will send you an e-mail to confirm that your order has been accepted. Our acceptance of your order brings about a legally binding agreement between us. All orders are subject to availability and if your order cannot be fulfilled our Substitution Policy comes into effect. Payment will be debited to your account before dispatch of your order. "

I wish to therefore point out that by debiting my bank account and sending me this aforementioned confirmation email, you have created a legally binding agreement. This term is stated by yourselves which constitutes an admission. I would suggest that Avon Cosmetics Ltd look to settle this matter shortly as they have clearly broken a legally binding contract, something which doesn't bode well for the company, publicly or privately.

You have my terms for a friendly settlement and I hope we can come to an agreement on this matter before I have no choice but to escalate matters to a court of law.

    Yours Sincerely,

    Alan Shave

    Recieved today and looks interesting...

I'm not sure what to make of the e-mail I have received from Avon regarding the missing bubble bath:

Thank you for your recent email.

Please accept our apologies for these items being omitted from your order. These items have now been re-ordered as requested. Please allow 5-7 working days for delivery.

Should you have any further questions, please do not hesitate to contact us.

    Regards,

Does this sound like I'm going to receive the bubble bath free of charge? I don't like the bit where they say; "These items have now been re-ordered as requested". Hmm, are they treating this as a new order? All hell will break loose if they debit my A/C. Are they allowed to keep credit/debit card details and charge you without your authorisation?
  • is this a cave in I can hear slowly crumbling around us  :T :T :j

I am fuming with Avon now. I am trying to get back £2.70 that they've taken from my bank account which was payment for 2 eyeshadows which were ordered with the bubblebath promo. However they cancelled the order and I have received nothing at all from them nor any delivery info. Trying to sort this out is a nightmare. I received 3 automated responses in reply to my e-mails requesting refund but yesterday I thoought that i was getting somewhere when they asked for my full address etc so that they could 'loook into it'. well today I have received their response and guess what? Yep another automated e-mail about the damned bubblebath promo. I am getting the impression that they are not even reading the e-mails on this subject. I cannot beleive that a large company like Avon cannot get their act togetjher to sort all this mess out. I will get my money back even if I have to go to trading standards. I think the next step is a proper letter!
  • I really can't understand what all the fuss is about. Did you really want the bubble bath or just something for nothing?

I think Avon have been good to offer the 20% discount to people. Probably worth more to you than a bubble bath.

I'm nothing to do with Avon just a busy mum whose surprised about all the fuss and trouble people are going to to complain.
