As far as I can see:
-SORN does not cancel the Vehicle Licence which is for the payment of Vehicle Excise Duty
-SORN does not insist the Vehicle Licence is returned
-the Vehicle Licence is the paper one you surrender, not the electronic record held by DVLA.
The Road Vehicles (Statutory Off-Road Notification) Regulations 1997
http://www.legislation.gov.uk/uksi/1997/3025/made
Seems quite clear from para 3
Application
3. These Regulations have effect for the purpose of prescribing the particulars to be furnished and the declarations to be made, and the times at which and the manner in which they are to be furnished or made, by a person—
(a)who surrenders a vehicle licence for a vehicle;
(b)who does not renew such a licence; or
(c)who keeps an unlicensed vehicle.
Sorn means you cancel the licence, as per a) above.
You're then on the database as sorn'ed.0 -

That's the holder surrendering the Licence and "particulars/declarations" they need to provide/make when declaring SORN.

I'm sure there will be a court case soon, that'll give a definitive answer.0

We'll wait and see if the letters come out then.
Sorned, with the tax disk, on the uninsured car on the drive, or sorned, with insurance, and the tax disk in the window, passing the ANPR camera.
If you're right, they'll be fine.0 -
Good Luck on your mission michael.d :cool:
You will probably get away with it, but a naughty bit of me wants you to get stopped just to put this ridiculous DVLA ruling to the test.
Let us know when you get back safe.
Well, made it to comet, skip, petrol station & even visited my parents on route with no problems so looks like this plan may just work after all..... just a shame it took all day while the wife decided what she wanted at comet....lol0 -
I have other rubbish to take to the skip too, currys wont take that.
Im basically just doing as I have done for the past 2 years, just getting temporary insurance when I need to use the vehicle but under this new law I had to SORN it or risk getting a letter/fine because it was uninsured... even though It sits in a garage gathering dust most of the time.
Anyway, I will see how i get on today. I havent cashed in the tax so I have paid to use the vehicle on the road, I now have 2 days insurance & It is MOT'd so Im hoping theres not going to be any problems.... I will find out soon.
Thats what really annoys me about this new law, Its good to get uninsured drivers off the road but they way they implemented it will force law abiding road users in situations very similar to me into "bending" the law.Well, made it to comet, skip, petrol station & even visited my parents on route with no problems so looks like this plan may just work after all..... just a shame it took all day while the wife decided what she wanted at comet....lol
So you didn't get caught.........this time. A statement made by most criminals but they all get caught at one time or another!!!Everyones opinion is the most important.....no wonder nothing is ever agreed on.0 -
Who do you report uninsured cars to? There is one parked down my street on a corner. It hasn't moved for weeks. It belongs to someone down my street and it is often left unmoved for weeks/months on end. It was left unmoved further along the street not so long ago with no tax until one of the neighbours threatened to report it to the DVLA when it was blocking his access. Which the owner of the car promptly re-taxed.0

It must have been insured to tax it.0 -

your making an assumption its not insured, you could check the insurance database to see if it is insured. If its not the owner will get a letter soon enough anyway unless he/she has declared it SORN.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0
