This whole new law is utterly stupid! We've just purchased a car for our daughter. she does not have a full license as yet and we keep the car in a garage. I intended to drive it once a week around the block to ensure everything was ok and to circulate the oil etc. I am insured to drive any other car, third party as long as it does not belong to me. I now cannot do this as according to the DVLA the car is not insured. So, we can either SORN it until my daughter has passed her test and is ready to use it or I can find out about adding it to my insurance and all the messing about that would entail.

I'm going to send the tax disk off and SORN it.

    Ridiculous!!!

From the dvla point of view, you're either taxed, or sorned, or not declared. They don't have other options. So if the computer says you're sorned, and the ANPR picks you us, having a tax disk you didn't get a refund on will just mean you're paying the fine, and wasting the refund.

If you SORN a vehicle then use it on the public highway (the road) without retaxing it you are breaking the law. If you get pulled up by the police it does not make one iota of difference if you have what looks like a valid tax disk on display. They get up to date information with a quick computerised search. You will then be prosecuted for not displaying a 'valid' tax disk.

in a case like yours i think you can buy an insurance called 'a laid up policy' not sure if thats the right name for it though, and if your insurance lets you drive any vehicle you should be ok taking the car out for a spin now and again as you wont have to sorn it.

Hi, after reading all these comments Im now unsure whats best for me to do but do see things as follows.....

I have declared SORN online & am planning on keeping the disk. That way i can still get temporary insurance & it has a tax disk I can display on the rare occasions I do use the 4x4. Now if DVLA decide to be funny about it I can see a slight flaw.

They cannot do me for not having insurance/tax if im seen with ANPR/police on the road if i do use the vehicle as I will have tax/insurance & I can simpley claim I know nothing about the SORN & someone else must have delcaired it. You only need the V5 document number & registration number to declaire a vehicle SORN. I could simply say i must have left the Documents on view in the car & someone decided to play a practical joke. Theres no way to prove who actually submitted the SORN.

On they other hand they cannot do anything about the vehicle not having insurance because as stated under there new rules it is SORN against it.

If anything was ever said about having to return the tax disk I could simply say I did post it. Theres no way of knowing wheather I have or have not sent it back for a refund because It can be sent regular post and may have got lost... or more than likely DVLA have lost it.

I think this is just making things very difficult for people who are genuine road users... I have never driven my 4x4 on the road without tax/insurance & valid MOT.

I also have secret option plan b... This will only be done if I do have issues from DVLA & is not exactly 100% legal.

Quite sad really when DVLA are going to force me into driving illegally... rather ironic considering what this is suppost to do...

OK, plan b... I just had the thought that someone was going to ask so here it is.

I have a friend who has a 4x4 the same make/model & quite close in colour as mine.

If pushed plan b will involve me simply to SORN my 4x4, cash the tax in & pay my friend the small £40 it would cost to add me to his insurance.

Simply get a spare set of number plates made up & obtain a second tax disk and problem solved.... no one would look near me.... even without a tax disk to display it would still come up ok on computer.

I refuse point blank to be forced into paying for an annual policy for my 4x4 when I only use it maximum of 8 times in a year.

£80-£90 currently spend on insurance over a year

    V

    £400 + annual policy

    Which one would you choose??

at one time you could put your trade plates on your recovery truck seeing as it was mainly parked up
this was taken away about 18 years ago so one now has to pay to park it up but i still have to pay for trade plates as well
    so nothings new
ps a night in the cells might make you think twice about cloning a vehicle

    Maybe not the best plan.

And when they both come up on an ANPR check at the same time, but miles apart?
Or when you take it out and go to see him, and someone shops you?
When he gets all you speeding and parking tickets?

I like your thinking and I admire you if you try to put it into action. However, I personally wouldn't do it as the penalties for doing what you suggest are simply too heavy for me. I too have a laid up 4x4 and the tax is actually free as it's a classic vehicle. But, I would still have to insure it for the year even though I may only use it about 10 times max. in 12 months...

It may seem lika a good idea to try the above but if you read my earlier post #97 you will see the flaws.
Once you have sorned the car you must retax it to unsorn it, if you say it wasnt you who sorned it you could still get done for not having insurance for the period you were'nt using the car.
I like your plan b better but as pointed out there is always a chance with todays technology that you could both be picked up on anpr cameras at the same time miles apart. Years ago my Dad had 2 old ju250 vans which he kept in hi yard with 1 tax disc between them and the same plate on them, his reasoning was that he could only drive 1 at a time so why should he pay twice for tax/insurance.;)
