    How's it fraud? Obtaining pecuniary advantage by deception? Where's the deception? Tesco's policy is clear - if you are charged more than the price on the shelf, or the product, you will be entitled to a full refund and get to keep the item. There's nothing in there about knowing beforehand that you were going to be overcharged. Besides, there's no proof that you knew you'd be overcharged. Their POS led you to believe that you would get the phone for £147 odd when you spend a qualifying amount in store. You didnt get the phone for £147. You were charged £149. That's an overcharge. As such, you are entitled to a refund under Tesco's policy. Contact HO and explain to them what has happened. Also complain about being accused of fraud. "Fraud" my !!!!. Tesco is the one committing a criminal offence for putting up misleading price indications. You've done nothing wrong.

    had the same problem with bud specials a few months ago, rang the head
    office and was told I would get a call from manager within 24hours which
    i did and he told me to pop in the shop for a refund.
    Have you get a print out or some type of proof of the display price?
    if not go and take a photo and ring head office.
    Tell them you did'nt like the way you were spoke to and if need be you
    will get in touch with trading standards etc.
    Don't worry they will sort things out and you should get your refund.

    no photo, but i have a recipt at the £147 pound price and a recipt showing the miss price with writting saying £2 refunded on phone

    i often read the tesco posts and usually head office will tell that tescos to do a r&r but you may get banned from store.
    It is none of thier business but i would give at least half the cash to a childrens hospice or something and tell them that(maybe send reciept afterwards).
    You will get a R & R as its acceptable to buy 2 phones as gifts...not like the 7 mispriced cd person!


    Just read the last post you did. I would not have accepted the £2 refund though.

    Hi,
    I am in exactly the same situation - albeit for one of these phones. Same sign, same refusals by the duty managers. I called head office yesterday who were adamant that the policy is at manager's discretion, but that they would contact the store. I am waiting to hear back from head office. Your next call should be to head office, be polite and calm and just explain that they admitted that you were charged £2 too much (per phone) but would only offer this difference...If you find you have no luck with head office then you'll need to write to them but there will be people who can advise you with that as is necessary. Head office will be closed today, but call first thing tomorrow morning. Feel free to PM me...
    P.S - if they said the reason they would not honour their policy was due to 'fraud' I would not be happy - to me that is slanderous..

    Yep vippymini, call HO on the freephone number on page 1 of this thread.

    Personally I would not buy 2 of anything that is over £100 as you are asking for scrutiny by the Store Manager at the very least, even if the store pays out the refund. Then you will have been remembered by that store for next time...

    Hi does anyone know the scan price if Indiana Jones Tripple pack?.
    Our local tesco has them SEL is £2.xx higher than sticker.
    I've done a lot of 'returns' just recently so would rather be sure before I bought it.

    After getting full r+r on a nokia 6070 this week have been back to same store and been overcharged on the w810i, SEL 169.xx, with discount 147.xx charged 169.xx with no discount taken off, gonna pop back tomorrow and try for r+r, if they are funny can I just ask for a full refund?

  • You can ask for a full refund if you have got the receipt and still in original packaging. I returned a phone the other day and they didn't even open the box, but I'm sure they would usually just check to make sure its there. In my experience of returning failed R+R stuff, I've had no problems at all returning anything, apart from DVDs, Games etc which need to be sealed/unused.
