They would have to prove that YOU had acted with guilty intent,

and there must also be a victim, or someone who is disadvantaged whilst you gain advantage by the action.

As it stands Fraud would not be complete.

But to attempt a fraud is also a crime.

so, if you did have guilty intent, prior knowledge of the R+R, and they could prove this, the crime of attempt fraud has been committed.
