Hello, there are lots of - may issue court proceedings - but when the so called solicitor says we -will issue court proceedings - does this carry any more weight or not , regards gunboat.
Nope. They still won't!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

There is a thread on Pepipoo regarding this company taking somebody to court.
http://forums.pepipoo.com/lofiversion/index.php/t42471-50.html
It was a few years ago though and no update0 -
Using 'will' does mean something more than using 'may' - it means you can make a complaint to the Solicitors Regulation Authority about them when they subsequently don't.Je Suis Cecil.0

Not sure if this link is in the stickies or not, but makes for a very interesting read

Should i print off the whole of this thread and sent it to the sra highlighting posts 35 and 37 ? Also if this was to go to court would it be an idea to show all of this post to the judge. Thankyou.0

Gunboat this will never go to court, so why are you are so concerned about printing off the entire thread for something this company has never done. To put into context for you on the whole parking industry
2011
1.8m fake pcn's issued
845 small claims issued
46 claims heard before a judge
25 default judgements obtained
36,000/1 chance of getting to court
72,000/1 of losing a case
0 claims issued by this company last year
Now the default judgements were where nobody entered a defence, everyone who defended the case won. The information above was obtained by a FOI request to the courts.
Now please stop worrying about something that is not going to happenExcel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -

A bunch of people ruminating on the internet (however well-informed they may be) will carry no weight whatsoever in a formal complaint.
If you want to include what has been said here in your complaint then do so (preferably paraphrased) but do it in your name, don't just print off the discussion and attach it!
And don't ever even think of presenting an internet discussion to a judge as evidence of anything! I can see a judge being very, very unimpressed. Not that you are likely to be encountering a judge.Je suis Charlie.0 -
Not quite right, and we don't want to be seen to manipulate the figures the way the BPA did.
There were 845 claims issued.
Of these, 796 never reached a contested hearing, because:
- Some were default judgments because no defence was entered
- Some people settled ahead of a court hearing
- Some claims were dropped by the PPC when defence submitted
- Some were default wins for defendant due to no-show by PPC
Of the 49 defended and contested claims in front of a judge, 24 were won by PPCs, 25 in favour of defendants.
Still pretty good odds.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0
