Hi all,
The person we bought our off a couple of months ago has put a note through the door asking for the stuff back that he left in our loft (guitars/skis etc). The estate agent said it was legally ours as we ‘inherited’ it all when we bought the house, so we were looking forward to flogging it all on ebay!
He contacted the estate agent a while ago about this, and they gave me his number which i lost, so it seems he is desperate. As it was a rental property, it might not even be his to be honest, I’m just worried he may turn nasty if he doesn’t get it off us (although no idea what he is like yet!!)
Any advice much appreciated!
Thanks

Why be mean about it? Seems to me to have just been an accident. I'd just give him his stuff back.0

I have great difficulty in believing that the items are now yours simply because the seller (or tenant) forgot to remove them. I'm no legal expert but that appears ludicrous. Apart from anything else it shows you are lacking in morals, these items belong to someone else. It's someone else's fault.0

Vacant possession
Empty. On completion of a sale a seller is obliged to deliver the property with vacant possession which means clear of occupants and of objects which are not included in the sale.
Legally his, morally not.0 -

Guitars left in the average loft are going to be knackered from the temperature changes.
Do you want him to empty the loft? Or would you rather do it?0 -
Wow. They guy made a mistake and forgot about some stuff. He's tried to get in contact with you before by the EA but you didn't bother to reply.
Just do the decent thing and give it back to him.:staradmin:starmod: beware of geeks bearing .gifs...:starmod::staradmin:starmod: Whoever said "nothing is impossible" obviously never tried to nail jelly to a tree :starmod:0 -
How would you feel if the shoe were on the other foot?0

I was under the impression only things stated that were being left were yours?:heartpulsOnce a Flylady, always a Flylady:heartpuls0

Why even ask what to do, give them back. You were not expecting to get them, so you have lost nothing. Do the decent thing and give them back, if you dont then you may end up getting a few extra things you didnt expect either, like scratched cars or a broken window.0

Doing a search on vacant possession I can find nothing that states anything left behind changes ownership. All I can find is about the new property owner can sue the previous owner for any charges relating to the removal of the items left behind. Can you give me a link to what you've said about the articles now legally being the property of the new property owner. This is quite important as I have a friend in the same position as the OP.It's someone else's fault.0
