This is a rented property, the same rules do not apply.

The OP isn't renting it, they've bought it (from the landlord who rented it out previously).

Most tenancy contracts I have had state that if any property is left it becomes the Landlords after a set period of time.

Which given the OP has now bought the property of the Landlord makes the items theirs under vacant possession.

I would bin the stuff rather than give it back, why should anyone expect to have their stuff stored for two months at someone else's inconvenience and expense.

    1. I’m entitled to change my view of the situation once I have read replies, isn’t that the whole point of asking for advice? The only advice I had obtained previously was the estate agent telling us it was legally ours and we could do what we wanted with it..so yes, I was swayed by this.

You didn't change your view, you changed your story. You originally wanted to sell the items on ebay, that was very clear. You then come back saying you'd like to sell/give them to a charity shop, that is a change of story not view. If you'd responded by saying after reading replies you had changed your mind, that would have been a change of view. Accepting your added story still doesn't make your actions correct. Your vendor may be a bad person, you still have the choice to stay a good person but it's your choice.
    It's someone else's fault.
  • Does your contract say anything about chattels? There was a lot of stuff left in the house I bought last year, but my contract stated that I had no legal right to any of the chattels (personal property I think...?). My solicitor advised I would have to look after these items for 'a reasonable period of time.'

I hate those kind of laws. What's reasonable to one is unreasonable to another, as is shown in this very thread. The law needs to be specific.

Yes they do. The property is still sold with vacant possession; of persons, property and of AST.

Blimey - I'm feeling guilty about the nasty clock and pictures I threw out that the previous owners left... hope they dont ask for them back!:o

I don't consider someone leaving a load of stuff in a loft and then coming back at a later date acceptable. Where does it end, can you look after our dog/cat while we get moved in and we will pick them up in a month. How about can we come round and enjoy our old garden as we don't have one at our new place.

Do you want to bury your dog in their garden too? ;)

What tenancy agreements have you been reading.

I can't see that being right.

Charming......rather than allowing the rightful owner to return to retrieve their belongings, you'd rather drive it to the tip? :wall:
The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark

If the previous owner had left his car in the OP drive would you say it's now the new owner's right to sell it? The law would not concur. Why would any other item left be different?

Can't tell you how hacked off I'd be if someone did that. That would be worse, blocking up your drive. Totally selfish. As is leaving stuff in a house which isn't yours.
