  • Today I bought a banana costume from the local 'Hollywood just for fun' and as I tried it on when I got home I realised that it didn't fit. However previous to buying it, I was told it was a one size fits all and I wasn't allowed to try it on in the store. After realising that it did not fit I immediately contacted the store and asked them if it was possible to return to the store and return it, only to be told that even with the receipt it would be impossible to return it because they simply don't do refunds. Is there anything I can do and am I entitled to a refund considering my circumstances.

    Even considering your circumstances, no you are not entitled to a refund.

    This is because there is nothing wrong with the product.

    You have no statutory right to a refund in these circumstances.

    Always best to consider all sales final unless advised otherwise.

    It is of course too late now, but if you are unsure that the goods are suitable, your best option is to ask if a refund would be possible, and if refused then make the purchase elsewhere.
  • I have a tablet which I purchased in May, it is not working properly. I have the receipt but not the box. Will I still be able to change it for a new one ? I brought it from Sainsburys.

    You can take it back to Sainsbury's but it's up to them whether they offer you a refund, a repair or a replacement.

    I purchased some made to measure doors online. They arrived damaged last Monday. I immediately called up to complain and they verbally agreed to refund, after seeing the doors. The courier returned the next day and collected them.

    I have now received an email saying they have inspected the doors and agree with my findings. However they are saying that consumer law means I have to give them a chance to rectify any faults and if they come back damaged a second time, this is when a refund is issued.

    I am pretty sure this is not the case, despite them being made to measure. Can someone please confirm?

    Secondly, I have not yet given written notice that I would like to reject them (didn't think to after they agreed refund verbally). Is this going to cause a problem since they've been returned already?

    We bought a dishwasher online from an established website. The dishwasher was not cheap, over £600. We've had it 6 months and its already broken, and its a design fault that many other people are reporting with this model. To cut a long story short, steam gets into the door where the controls are and melts the glue and the buttons/controls fall off inside the door.

    We contacted the manufacturer and they arranged the engineer who has just been (after waiting 2 weeks).

    Now, I'm not convinced this machine will last a reasonable amount of time given its value, and I contacted the website we bought it off and requested a refund or exchanged for a different dishwasher. They rang us back and said its nothing to do with them and that our gripe is with the manufacturer.

    Is this the case, and if not what can I quote to them with regards to the law to get them to take it back?

    They are wrong.

    Here is an extract from MSE's Consumer Rights Guide:
    Know who's responsible

    When returning items, beware shops trying the oldest trick in the book: saying they're not responsible for the shoddy goods and you must call the manufacturer. This is total nonsense!

    If a company fobs you off by saying “go to the maker instead”, it's wrong. It's the retailer's job to sort it.

    It doesn't matter if it's an iPod from a high street shop or a designer frock from a department store. If something's broken, torn, ripped or faulty, the seller has a legal duty to put it right as your contract is with them.

    This is the first time I have made a posting. I've been working hard over the last 3 years to get out of debt. We decided this year to restrict the money we spend at Xmas on our 4 kids all under 11 and spend a maximum of £65.00 per child.
    My two daughters wanted tablets and I found 2 on Argos clearance on eBay refurbished for £62, so I ordered 2, although they were severely cosmetically damaged one worked the other didn't, so I sent the one that didn't work back. They said they could replace it, so I ordered another 2 (yes stupidly I had not received the money back at this stage). The 2nd lot arrived and again 1 out of 2 worked, so i sent the broken one back. Argos have now emailed me saying that the boxes serial number doesn't agree with the serial number on the tablet and therefore will not refund, the 2 I have kept also dont match, so all 4 were in the incorrect boxes, which had obviously been opened, they had been either display models or returned as broken items.
    I have opened both as items to the eBay resolution centre, what chance do I have of getting a refund, starting to panick as I have no money to buy my sons presents until I get a refund.
    How can I prove that the tablets came in the wrong boxes.
