I purchased a used combi unit from optical marketplace, (a website where you can buy and sell optical items).
It was bought as working and should not have been dismantled until we had viewed it. The seller dismantled it, guaranteed it was working, we collected it and took it to our opticians but when we assembled it had a fault.
The seller then went on holiday for 2 weeks, during which time an engineer was sent out who couldnt repair it.
after 4 weeks it was finally repaired yesterday.
I was wondering if I am within my rights to request a discount due to the inconvenience and the fact that it has taken up space in our testing room therefore delaying us from setting up our sight testing room.

If so, then you will not have any consumer rights.
Any rights you may have are those agreed at the time of sale.
You may well be due something from the seller because the thing was sold as working but apparently wasn't and needed repairs.
Having said that, of course you can request whatever you want.

I bought a telescope via the internet ..it came from a shop but I purchased it on-line ..Unfortunately i have a fault with it and have requested that the faulty part is replaced as it is not repairable (it is 6 months old so in warranty)...I have contacted the SUPPLIER initially and it is a fault they are aware off .I have also contacted the seller. They want the parts returned for inspection before I get a replacement or repair , as i said it is NOT repairable plus i need the equipment.. I have supplied photographs of the faulty part and stated I was told that the are they aware of the particular fault and it is a non repairable ..this is ongoing now for over 2 weeks ..who is responsible...I cannot afford the P&P for return myself as it is expensive as heavy, they have even suggested I return it at my expense ....I am still waiting to hear from them ...so where do I stand ....0

Have a read of MSE's Consumer Rights article and in there you will find that if the fault is inherent, then the seller must provide a remedy which could be a repair, refund or replacement.
You can request which remedy you would like, but cannot force the seller to provide a remedy that is disproportionate.
So effectively the seller chooses the remedy.
Read that MSE article, and if the seller is obliged to provide the remedy, then he must cover all costs in doing so.
He must also do so without causing significant inconvenience.0 -
Hi, I am not sure where to go with this but my problem is this:
In August 2011, I purchased an Onkyo Amplifier from a high street store that came with 2year manufacture warranty.
In August 2012, the item stopped working. It was not fit for the purpose (Output sound through speakers). Under warranty, i sent it to a authorised service centre for repair where the problem was fixed.
Now in October 2013, the same fault has occurred again and this time i am out of warranty. Having browsed through the internet regarding this fault, it seems that this is a common fault that has happened to many Onkyo users and all are having the exact same issue.
Onkyo have failed to reply to me reporting the fault. Not only that but they do not answer their phone (Europe HQ is in Germany) and their online chat is always off. Viewing their facebook page, they have many many complaints about this issue.
What grounds do i have in either having the fault repaired for free, or getting a full refund/replacement? It clearly looks like their is a specific problem with their amplifiers that they will not admit to?0 -

Who are they?
A manufacturer's warranty is in addition to your statutory rights and after it has run out the manufacturer owes you nothing.
Of course some manufacturers will go beyond what they legally need to do, but from what you say, Onkyo isn't one of them.
Whoever sold the thing to you has responsibilities towards you for up to six years.

Has title, if warranty sticker broken or removed to get into pc case to clean or upgrade, then warranty is voided.
Is this still allowed, I thought owning a PC meant it was just that, a personal computer.
Company in question is UK Gaming Computers, and from what I can gather is about the only company doing this.
Its nearly 1yr old, and there saying I cannot open to clean inside, but they will do it for me, with obvious costs involved.0 -
Please can you tell me where you stand if you return an item a day after delivery if you discover it as an intermittent fault. Yet the company you purchased it from claims it's not faulty and refuse to refund? Thanks0

In august 2013 I subscribed to a large magazine chain as they had an offer £10 for 12 issues and free Joules wellies. My money was taken and to date have received 2 issues but no free wellies. I have called their customer services who just laugh and tell me they are waiting for more from Joules and they have hundreds of people on the list but they can't say when I will get them. I think they are deliberately holding back as after 6months from order they will take a further subscription payment from me. If I cancel my subscription so no more payments are taken will they still have to supply me the boots?0

Was this with Country Living magazine?
There are a lot of people with a similar problem on HUKD, but it does appear that wellies are appearing... allbeit slowly.
