  • Hi, I am new to the site and was wondering if someone could help me. Last year in June I purchased a Skagen watch for my fiance and within a few months a few of the crystals fell out, this was not a problem and the shop replaced the watch as it was within 6 months of purchase. Its now happened again but on the Skagen website it says that crystals are not covered in the warranty, this is the second watch that it has happened to. I am just wondering what I should do about this as I can no longer return it to the shop but there is obviously some problem with the quality of the watch. If anyone could give me some advice it would be much appreciated. Thanks....Daniel

    The manufacturer's warranty is in addition to your statutory rights. As such, the manufacturer can exclude what he likes.

    Your statutory rights lie with the retailer.
    You say you can't go back to the shop, why is that?

    You are only going to get a remedy by dealing with whoever sold the thing to you.

    Just to add... if you paid over £100 for it and the retailer no longer exists or is refusing to help then you might be able to use Section 75 of the Consumer Credit Act to your advantage.

    Sale of Goods Act allows you up to six years after purchase (in England) to make a claim against the seller.

    You may need to prove that the fault is inherent, i.e. it was present at the time of sale but maybe not apparent then.

    Ok Thanks I will give that a go as it is the second watch that it has happened to.:)
  • Hi, I set up a Direct Debit with my local leisure centre for swimming lessons for my kids. I've noticed that the DD has appeared on my bank but no money has ever been taken (it was set up in Oct 11) When I've looked at the contract I signed at the time, they have typed for the first payment to be taken October 61 - now this is obviously a typing error, but they've signed it and I've signed it - if I tell them now and start paying, can they make me backpay to last October, even though its their error?

    On Friday a neighbour took in some parcels for us, some of which were delivered by a reputable courier company.

    On opening the parcels we noticed that one was not even addressed to us - it was for a local branch of a high st. retailer from their warehouse.

    Who should I contact to have it collected, the courier or the company who the goods should be going to?

    Give it back to your neighbour.
    If he has started to take in parcels for this retailer that is nothing to do with you.

    Alternatively, you could either phone the retailer or the courier.
    I am sure either will be happy to help.
