Why can't he prove he didn't follow the process ???
He can prove he sent the emails as requested within the 2 weeks quite easily with copies of the emails with headers ....if he takes action then mobiles.co.uk have to put up or shut up ...the only way they can prove they didn't receive any (which they've already admitted they have by the way) is to provide their data for the dates in question.
Sorry, I should have said that he can't prove that they acknowledged receipt as their email replies have been deleted.
Even if one can prove receipt of an email, it is much harder to prove what was in the attachment.
But as I said, it will be interesting to see how this develops0 -
Hi Silk. How's it going? When you write "I can quite easily see the confusion of the OP thinking he would get the cashback when he had finnished paying for the contract at the end." you can't really mean that, surely? You have to concede that the t&c on when to claim and when you get paid are pretty clear and the only reason for thinking that you get paid at the end is if you don't bother to check what you are signing up for.
The OP has realised he hasn't been paid and is now chasing it ....to be honest due to a slip up at my end I'm chasing a debt thats over 12 months old from one of my customers .....although I should have chased it long ago in fairness they should have paid me by now without chasing they had the bills and the reminders but then was wrongly marked at our end as paid but they hadn't...it's the same thingAs far as not responding to emails, they appear to have done just that as Daddy says. Possibly the only mobiles.co.uk's customers who has ever said that ! :rotfl::rotfl:
Oh no hang on Ben said he deleted them all by mistake instead of replying to them :rotfl::rotfl::rotfl:It's not just about the money0 -
Getting a great reunion feeling here. Just like old times.
You, me, MJ and mobiles.co.uk. Differing views - although maybe MJ and I are closer on this one.
Where are all the others?  :beer:0 -

Been away?? Sadly not yet, but away in under 3 weeks now. :j
Problems with son, London and property - not a great mix and wish it was as easy to sort as a mobile cashback deal.
Sitting watching how this ends - good luck OP.........but you need it.

However it is usualy taken for granted unless contested at the time it was rec'd that what was in the envelope was what was required.
The advantage of proof of emails over recorded del is that usualy the content of the email will refer to an attachment sent etc
I've had emails accepted into evidence without question on several occasions one was a National Haulier who claimed they hadn't rec'd a pdf and the other was a County Council who claimed they hadn't rec'd a photo.
The Haulier was not a problem and accepted it had been rec'd ...the Council was able to come up with the excuse that their system had removed the pic due to censor limits before it was opened....however it was accepted that we had done our bit and sent the pic
Neither actions were taken or defended by ourselves by the way. It's not just about the money0 -

Speaking of others ...Hiya Lynsey :kisses3:It's not just about the money0 -
but it is not right to write that mobiles.co.uk should pay up regardless if Daddy can't now prove at this late stage that he did comply.
Although poorly written, to clarify, I was thinking along the lines of an Easter gesture of goodwill GD. Let me restate the offending remark: Set aside the right or wrong of it show you (mobiles) really care and pay Daddy's claim please.

Thanks for all the advice.
It's going nowhere with mobiles.co.uk
It seems every reply I get comes from a different person asking for different things and coming back with a different answer.
Just to clarify, I thought the cashback was payable at the end of the contract. At the time of taking the contract, no information on the cashback was provided, and I have email proof from mobiles.co.uk explaining when to send in the bills, but not explaining when the payment(s) would occur (in answer to an email I sent them asking them to explain the cashback deal to me).
I have since sent them original copies of all my emails (containing the required bill copy), as they asked for. The emails have all been attached to a new email, so you can see details like date sent, who to, etc. Their reply to my email (even though they only asked for copies of my email) was that I need to send them the automated replies they send out when receiving an email. Sadly, these wern't kept. I have a habit of just deleting those auto-replies. Obviously this habit will now change! And I wonder who keeps those replies?
Silk, the phone was ordered 27th aug 2009.0 -

Me. I make sure the dealer simply cannot refuse to pay. That also means that if I don't get ALL the emails in VERY good time I take action. Acknowledgment is one thing - I want written acceptance of each claim as well.
The t&c were (have always been) easy to find on the site at the point of sale (and you should digest theme well before that) and NO dealer pays cashback at the end of the contract - except the last instalment.
When you're offered something for nothing you should really ask a LOT of questions and ensure you know how it all works prior to committing to a deal.0
