    Daddy. Have you got any further with this yet? I haven't bothered to plough through all of the correspondence on this thread, but from what I've read you seem to have a good case.
    I took on CPW recently and eventually won, so I hope you do the same. I've just posted a new thread on here (Carphone Warehouse experience) in the hope that it might encourage a few more people such as yourself to do the same.

    It happens a lot with CPW's companies (paying up at the last minute), they just need action to be taken (as you did).
    Your report shoild give confidence to take acton against any company, not just CPW group of companies.

    I fully endorse your "Lesson number 2".

    It is rather sad that nowadays "customer service" is a distant memory with most organisations. Where they can get away with things they will usually try - and succeed, which is why they do it. They only thing they do ultimately recognise is the force of the law. For those prepared to use that, redress is still possible. Otherwise all you will do is get increasingly angry as you waste copious amounts of time, effort and frustration banging your head against a brick wall. Some cpw employees do try their best - others really do their worst. CPW has a long history of making faulty phones worse, denying their legal responsibilities and playing games with the people who enable them to survive. They are not alone in that - so the safety net of small claims is often the only resort. Regulators are generally a complete waste of time and going to places like "watchdog" is likely to get you nowhere. For any one complaint which is actually addressed there are thousands which are completely ignored.

    My best advice is "if it's to be, it's up to me!". If you can't get quick and proper redress and can prove your case, using the law is definitely the way to go unless you are willing to walk away (as most people no doubt do!). When you use the law it is extremely unlikely that you will end up in court - but if that happens you are likely to win if your present a good case.

    Well I was going to treat myself to a smart new phone via mobiles.co.uk. But having read the feedback now not so sure at all. Would kick myself to get ripped off. Even though I'm sure I am not as forgetfull or assuming as some people - I'm not sure I want to take the risk. mobiles.co.uk your loss. I probably won't get one at all now - I don't need one, I just wanted one. I can't justify £600 on a phone, but could justifty £400, if only to save any more arguments on where the b***** h*** are we, as the phone I want is GPS enabled.

    It would be £25/month, with a promise of next day delivery, unlocked brand new phone, and £200 cashback by redeption. On the high street the same phone is more like £25/month + £99 to buy the phone or £30/month to get the phone for free. Seems that the offer is too good to be true, how can they sell them with £300 off the high street price?

    Simply because they sell the phone with a contract and the commission they get from a network is bigger than £300.

    @grumbler But then why don't the networks just sell the phone cheaper themsleves. If the difference was under £50 I'm sure we would all be trooping into the network's shops and buying direct feeling safe in the knowledge that we can take it back if it breaks and have dealt with a company we know. But that pease of mind ain't worth £300!

    Do you really need to know why? Because they will have no dealers then?

    Having said that, it may be not bigger than £300. It may be £300 or even a little less. Mobiles.co.uk build their business model on an assumption that a significant part of their customers will fail to claim the cashback properly or will fail to be persistent enough if the claims are denied or ignored for various reasons.

    On a need to know basis - probably not. But it all helps in the understanding of is this just one big rip off and the phone + usage costs £700 over 2 years so either justify it or stop looking. OR actually it does only cost £400 if you shop around and it's the networks with their flash shops who are the ones ripping us all off.
