Unfortunately I've experienced so many poorly trained staff in retail environments I'm not sure I trust them to understand the law. I do realise there are many exceptions to this. However, Valerie seems to reinforce my point.

I understand that receipts are proof of purchase as I work in a retail store myself, however I do know in the store I work at they will take a debit card statement as proof of purchase.

I think the OP has made the classic mistake of thinking that something that applies in the store she works at applies in every shop.

I have to give a differing opionion here. I think many of us having been students at some point know we buy things we want, and counting pennies kinda comes later. I know it did with me! Plus, River Island once retained my card when I was a student. It just so happened that it was a new card and for some reason had not registered as valid in their machine. But RBS told me at the time they had no right to retain the card, whatsoever. It transpired, that the card did in fact work, and it was their card machine. But this had left me with no access to money, till the Monday and I had gone into the shop on a Friday. So understandably was furious. Write a letter to head office, demanding a refund and make a copy of the statement. I cannot see how a statement is not sufficent evidence, if you have proof of purchase, as well as proof of address to back it up. But do it in writing, as I suspect you will get further doing this, though it may take longer. Good luck.

I have als obeen a student, didn't think about money from one day til the next until it run out.... but stupidity doesn't give you additional rights in the eyes of the law.

Op, use this as a learning experience... when you shop in future, always read their terms & conditions which will include their refund/exchange policy, time limits, acceptable proof of receipt in cases where you have changed your mind.
By purchasing the item these are the terms you agree and adhere to, anything else is strictly down to goodwill.

Its only if the item is faulty a bank statement can be used as proof of purchase, as everybody else has said, unless it says bank statements are accepted in their terms then they do NOT have to refund. Exchanging is also out of goodwill, most likely.

Don't get me wrong here as there are so many dedicated, down to earth, intelligent students in educsation.. but equally, there are too many naive students who think they can do what they what, as they please with no consideration for how the business actually works or who is affected and how. ( I think the words i'm looking for are self absorbed/selfish/idiotic).

I know because I was once the latter (6 years ago mind) ;)

When I was a student I never spent more than £10 on a pair of jeans and £5 on a t-shirt, all my clothes came from Tesco. And nothing much has changed! It's a little hard to plead poverty after spending £50 on clothing.

Anyway fingers crossed Valeria comes back and reveals the secret law to us.

i just cant wait to hear this secret law, i wonder if it would work
  • I've worked in retail (yes really!) and in the shop I worked in, without the receipt it was only an exchange and that was at your own discretion.

I remember one woman who tried to exchange a top she'd bought 8 months previously without the receipt as it "didn't fit" when actually she meant that "she'd washed it so many times the writing had all faded".

She didn't get a refund or an exchange.

Erm, I have also worked in retail, and if it's within a certain space of time, returns do not have to be on the grounds of it being faulty.

Perhaps you weren't in the day they explained the SOGA. ;)

In my student days I'd have never spent £50 on a dress... christ no; I saved all my money for wacky and LSD.

With respect, Valerie84, I can't see any similarities between the OP's experience and yours.
You mention a card retained by the store, the OP has lost a receipt but wants a refund.
That's like comparing apples & elephants and saying they're the same size, colour and taste.

Encouraging the OP to 'demand' anything in the circumstances as described is irresponsible and guaranteed to get her absolutely nowhere.

Erm - I think you're doing the same as the OP and basing how the shop YOU worked in handled returns/refunds as opposed to what the law says they must do.
