Mmm actually, thinking about it now, If what is said about ATOS and mental illnesses, I would have thought that if someone is capable of organising, accessing and then sending off lots of evidence, would ATOS not see this as someone capable of working? As the above process would need concentration, motivation, determination etc. all of which some people with depression or other mental health problem would find difficult.

I don't have a date for assessment (yet!...everyday I wonder if the dreaded envelope is going to arrive).
But, when the time comes, I will not be filling in the form myself. I will be going to DIAL. Coordinating of paperwork et.c will be done by my amazing carer/mum.
If ATOS assume that accurate completion of the forms means I am capable of work, they are wrong!0 -

Heart leapt into mouth last week when I saw the dreaded brown envelope on the mat - it was about the increase in DLA rates though - phew!“You can please some of the people some of the time, all of the people some of the time, some of the people all of the time, but you can never please all of the people all of the time.”0 -
I'm going to follow pinklady21's advice: write to the DWP asking why I'm being assessed now a mere 5 months later; requesting all the paperwork related to my last IB50 etc. and telling them that assessing me now goes against their own March 2011 guidelines.
If they persist I'll see my M.P. at his next surgery and he will contact them. (He's a pretty left of centre Labour M.P. who is opposed to many of the benefit changes)0 -
Just to say you can download a copy of the ESA50 from the internet and save it to your computer (get the interactive version).
You can then start filling it in a bit at a time (remembering to save).
When the brown envelope does drop through the door, you get six weeks to send it back. But you can print off the form you have online and attach it to the paper version, and send that back.
Doing it this way means that you already have your head round it, and have time to get any additional information that you might need.
Hope this helps
DaisyI'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

But you will not be able to stop them thinking it will you?
There was a thread on here sometime back that asked about this very question. The ATOS assessor asked the claimant how they had been able to complete the ESA50? So they must consider the question.0 -

You must remember that notwithstanding what the statement said, the DWP have every right to re-assess anybody when and if they want to!0 -

I haven't had a look for a few weeks, but is the ESA50 that you can download the new March 2011 version? Last time I looked it was the 2008 version.
The new version is totally different than the old one with new descriptors and questions. I doubt they would accept the old version if you sent that in now. You might have got away with it a month ago.0
