You'll find a guide to the AQ in the Reclaim Help thread and no you just send it back to the court although its probably best to keep a copy for yourself.

Had a look at thread you advised and also the info on CAG and I am now very confused do I use the new strategy for AQ?
They have a template for Draft Order of Directions and advise using this rather than Standard Disclosure they also state if using Draft Order I send copies of AQ and attachments to the defendent.
Can you advise me which one I should be using coz I have not got a clue.

hi all. Help is desprately needed here. Yesterday i recieved a letter and the allocation questionaire from the court and it is sat looking me and i havent a clue what to do with it! Am hoping someone will point me in the right direction!

The letter i recieved from my local court says:

You have already been sent a copy of a defence recieved from the defendents in this claim. The time for all the defendants to file their defences has now elapsed and i am enclosing an allocation questionnaire for you to complete. No futher defences have been recieved.

You must complete the allocation questionnaire on or before 9th August 07 and return it to the court office at ***************

A fee of £100 is payable by the claimenton the filing of their allocation questionnaire.

Can somone tell me if this is normal to have to pay another £100?? And also give me some help filling the questionnaire in?
I'm starting to wonder if i have done the right thing taking this to court as i really don't have a clue, but don't want to let those b***ards keep over 6k of my hard earned money!!
Any help or communication would be much appreciated!
    Thanks!x

You'll find the guide to the AQ in the Reclaim Help Thread which is linked in my signature. The £100 fee is payable if your claim is more than £1500.
  • hi just wondering if any one can help

we have got to the point of going to court and have been sent the allocation questionaire. I applied for court action online so it was only basic info that went on the online form.I was wondering how much info i have to send with the form#

for example copy of letters sent & copy of statements where charges occur etc:

i am going to go ahead with the court case (its against Barclays) untill they stop me!

any help gratefully excepted form has to be in for friday

You'll find the guide to the AQ in the Reclaim Help Thread which is linked in my signature. You don't need to send anything with this unless your claim is more than £1500 then you need to pay further court costs of £100.
  • Thank you for the link it was really helpfull.

Our claim is for £3000 so i had to pay £100 fee to the court.

I gave the form in on Thursday and then i have recieved a letter from Barclays saying that they are putting a stay on our case and all other cases. so now i have to wait for the outcome of the OFT court case,

    we are gutted !!

What Barclays mean is that they are asking the court to stay the matter that does not mean the court will I suggest you write to the court saying that you object to the stay you can find reasons on this site as well as the CAG and penaltycharges.co.uk site. Also on the penaltycharges.co.uk site you may find a copy of the judgemnt in the case of Terry v LloydsTSB send a copy of that to the court with your letter saying that this deals with tthe point so thee is no need to stay the matter pending the test case.
As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
