An offer of £10 was made by the Defendant. A counter offer of £300 was made by the Claimant.

    No agreement was reached.

Glad he stuck to his guns on the £10! Does/can the mediation offers be put before the court Alexis and as such his offer to reimburse their actual damages is know to the judge?

I can't see anything but a spanking on this one for Parking Eye in court and still find the whole thing very odd! Why court and why now and why with Pannone?

I struggle to see what Pannone propose to run with but seeing as this is their first publicised outing on behalf of a PPC it will be interesting to understand their approach. With Trethowans (something of a south-coast equivalent of Pannone) taking a regular trouncing on behalf of NHS Trusts one must question the wisdom of their northern counterpart's involvement.

The conspiracy theory could well have it that with PE being close to the top of the PPC tree they might just be trying to provide more evidence of the putative position that "even with the big guns in play the law fails us". It being suggested that this position might be being exploited to strengthen an argument for further legislative relief. In other words they are aiming to lose spectacularly on the basis that the negative result can be used to greater effect to support a call for further and more advantageous (to PPC World) changes to the law.

Two years ago these threads talked of court action by the smaller PPC's. Suddenly, they seem to have gone quiet but the bigger boys are back at it. Do we see the hidden hand of some organising body at work? Could this be the BPA AOS or are we talking of some inner cabal?
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

What happened in mediation would only be known to the judge if one or both of the parties mentioned it in their court bundles.
  • I had a letter from parking eye over 6 months ago then another and so on until I received a letter from PE legal department, they have recently parked outside my house after a letter saying they would clamp my car, but nothing has happened its just intimidation.

  • PE threaten to clamp vehicles at the Welcome Break Services for vehicles that return to the site with unpaid parking charges. I do not know if they use a clamping company or its just normal PE bluster. I saw a sign to that effect at a motorway service area on the M4.
Still waiting for Parking Eye to send the court summons! Make my day!

Then those clamping would be illegal, besides PE only use CCTV footage and dodgy software to work out if you have overstayed your welcome and the Welcome break.
  • If possible don't use service areas or car parks that use PE, this would give them a shock it is only the traffic that keeps these guys in business. How much time do we waist writing to each other about our issues with these companies.
