    We don't know why PE have had a go with this one, but it is slightly different from the norm as it was a P&D car park. Also its for 2 invoices, also its a solicitors that PE don't normally use.
    It would seem that unfortunately they have chosen poor Smithy to try and prove a point. If PE were ever going to try a case in court this is probably one they would fancy. However it would still be needed to show they are recovering their losses and not imposing a penalty.

    I for one have been following your case on Pepipoo, and sincerely hope you win. However if you lose I don't think it will alter the fact that ignoring them is best practice.

    I hope the OP wins.

    Its about time the Local courts worked for the people and not the corporations, How can they justify a £60 charge to £120 ? How can they even justify the £60 to start off with, They have no authority to issue a penalty, None what so ever.

    Its a shame its not about recovering true losses at all, But its about extorting hundreds of pounds off hardworking innocent people.

    Normally a banker, but unusually again this is a reputable solicitors, which makes it even more unusual.

    Even if PE win it will cost them much more then they will ever recover, which again makes you think what's it all about.

    Surely on a website such as this people should be given either side and allowed to make their own decision. I fully agree that people should ignore them, but surely rather than people being told that they will win and only the ones going in the press where the PPC loses we are not actually giving anyone the correct picture.

    If I knew there was a chance I may lose I may have paid £120 in the first place and been done with it. I might not, but it would have been a more thought through decision, rather than coming on a website and being told 'Ignore them, they never take people to court', with no evidence to the contrary.

    If the court rule for them does that make them a 'shower of scammers?' or does it prove they are within their right to do this.

    Hmmm...Parking Eye could not have said it better themselves ....your stance is ..er..interesting.

    Fact : 99.999999% of the time parking companies do not take court action
    Fact : No one here has ever said that they NEVER do
    Fact : 99% of the time Parking Companies lose at court
    Fact : No one has said they always lose

    Fact : Even if they win County Court judgements do not set precedents , so no it does not " prove they are within their rights to do this."

    Fact : Scammers is an accurate term for the following reasons :-

    1) Continuing to use a camera system that issues charges based on incorrect data

    2) Issuing a charge notice which states that the owner/keeper /hirerer is responsible for the charge (not true)

    3) Implying by letter that if you do not pay your credit rating is affected (it isn't prior to an unsettled CCJ)

    4) Stating that if you get a CCJ and don't pay,baliffs WILL attend (not true should say may attend)

    5) Quoting the 2008 Thomas case with an implication that it sets a precedent (it doesn't)

    6) Signing a letter as "John Mitchell" when no such person is employed by the company .

    What you have to understand (and don't seem to) is that in my only personal experience of PPC's I have been taken to court. In your personal experience I believe '5 -YES -FIVE Parking Enforcement Notices from a well known Private Parking Company -all ignored -NOTHING HAPPENS except junk mail'. You say 'NOTHING HAPPENS' in capitals, that might not say the word never, but you seem quite clear that nothing happens. I am not saying you are wrong, you probably are not, I am saying that if I had been aware of my case previously, if I were to lose, then I may have had to think again as to whether to go all the way.

    Many of your points on scammers are in my defence and court bundle so I am fully aware of them. I know CCJ's do not set precedents but surely if I were to lose the case then somebody in the same position as me should get the full facts before they make their decision.

    I understand why you are fully against these people, nobody hates them as much as me I assure you, but you fail to see both sides. Some people cannot afford to pay £350 if they were to lose a case and may wish to pay up early to save all the hassle. It has taken a lot of time and hard work from myself and AlexisV to fight this and sometimes it feels like £120 may not have been a bad price to pay to just forget about it all together.
