    Awaiting date due to Pannone wanting to delay it. Assume they have a backlog of 'proper' cases.

    How much delay are they allowed ..is it possible to claim an "abuse of process" or does that not apply ?

    Also once the claim is submitted are they allowed to continue to harass the defendant with begging letters during this "delay". ?

    Well, I would expect that one of the terms and conditions of the hire agreement is that you agree to allow them to release your information to such parties. Otherwise, it is a clear breach of the DPA.

    The legally of such terms is a debatable. You might be able to challenge it under the Unfair Contract Terms Act or the Unfair Terms in Consumer Contract regulations.

    Fraid not. It's just the equivalent of saying you are holiday between date x and date y. If they hold it up and up then it would be worth getting it struck out.

    So it is possible to have a claim struck out for an "unreasonable " delay ?

    As Alexis has said I am currently awaiting a date from the court as they have requested more time, so I have had nothing much to add. I was also getting quite a bit of stick for posting so much and it was apparently making me look fake, so thought I would stay away for a while.

    I think it has been said earlier on which court it will be at. Lets hope I can win the case!!

    Poor Parking Spy, they tried court to get an example, but it back-fired. I wouldn't be surprised if they cancelled the action (but then you could probably get some money back for them cancelling)
