Parking Eye Court Action

  • Hi guys,

Quick update, the court date is now set for 1st December but it has been suggested that I mediate before then so that I do not have to go to court.

Alexis has already sorted out my court bundle so we are in a good position but it does appear I may have to actually go to court to try and win this case.

Do you have a case number, I have some media contacts that would like to attend.

No idea why they are trying at all to be honest. But then I've seen 3 or 4 cases with other companies where they haven't paid their fee, stopped responding to the court or didn't turn up on the day.

AlexisV - Do you think they are looking at putting this in front of a court because Smithy used the same car park 2 weeks running, without purchasing a ticket, and as it was now a P&D car park they are trying to use this angle to try and justify he was knowingly evading payment and therefore think there is a very slight chance that they can potentially justify their scam charges in P&D car park?
  • Re last post by taffy056: A very valid point, and one of the appeal points if this actually goes ahead, the driver of the car is very often not the RK of the vehicle.

My question to you is this please: If a case like this goes to court , is the charge ticket issued for the car, the driver or RK. Surely a case would rest on this. Can you throw any light on this.

    Making my last post clearer

This is why wwe usually say don't take the proverbial as it might just get them thinking they have a chance. When its just the odd time then they are very rarely going to risk it
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

Not that this thread isn't relevent - it is - but it's pretty old and dead by our standards!

If only the case was dead! Almost every person who was all over this case as a fake and that I was making it up now seems to not be interested at all.

The court date is set for 1st December and it looks like it will be going ahead.

Vax2022, could you please PM me so I can see whether it is worthwhile getting the press involved. It has already crossed my mind on a number of occasions, especially if I lose as I believe I could be the first to lose such a case and it might make people realise it can happen.

So if you are unfortunate enough to lose to this shower of scammers ..you want to help them scam more money by advertising the fact that they might occasionally win ..for free in the press ??

Why would you want to do that ??

It is an acknowledged fact that these cases can go either way.

Hence Thurlow vs OPC was an appeal against the original decision i.e. OPC won but this was overturned on appeal.
