7DW just read some of your last few posts, what a huge trial its been getting to this stage and it seems not over just yet. Hope your sons flat purchase goes through ok and you keep progressing.. I did wonder why none of these things (to do with your sale) came to light when you originally purchased it? Maybe I missed that bit lol!!

Tanith, the reason that none of it came to light when we bought it was because we paid cash so no-one selling it to us really cared whether the deeds were up to date or not. We just assumed they were (as in the UK this would not happen, you assume it is the same in Spain, naive I know). Our seller never told us because it would have cost them a lot of time and trouble (and money) to correct the deeds, as it has us. I don't know why our solicitor never told us - I expect he took the Spanish attitude of, if no-one was asking you to do it, don't bother.
The reason we have had to do it is because our buyer is having a mortgage and therefore the bank have an interest in having the deeds up to date.
This is how business is done in rural Spain. Now I know better, i would advise anyone buying to get an independent lawyer (not one recommended by the Estate Agent, and not one in your immediate area), and have them thoroughly check all the papers.
Our son's flat purchase has completed, he moved in last Friday.

Now 7DW you must know it doesn't take much to confuse moi!.... reading your post before last you did say your son was moving April 10th , but he's moved in already?
Thanks for writing that all down I'm sure you have already included all that in your previous postings but I find I can't retain facts very long anymore lol... I seriously hope nothing more comes to light and your sale will be completed very soon... the Spanish do things their own way don't they. My brother has a beautiful apartment at the coast in Spain which they bought 8/9yrs ago which was a holiday home that could be sold when they got to retirement age and used to supplement their retirement , of course they can't sell it no one is interested so they have a beautiful place to holiday but may not have the funds to travel out there often..best laid plans and all that.. they haven't even been able to rent it out , and letting family and friends use it to holiday doesn't bring in much.

Sorry if I said April 10th, I meant February 10th.
Plans for when the house is sold? Spend a bit on our house here that we have just moved back into - maybe pay off the £25k mortgage we took out to give our son the deposit for his flat (it was supposed to come from the proceeds of the Spanish house sale) - travel a bit more - maybe go to Spain for a couple of months in the winter- see what happens.
I hope your brother manages to sell his house soon. We were so lucky to get a buyer, especially one who is willing to wait all this time. He knows he's got a bargain though. We dropped about 20% on the price.(AKA HRH_MUngo)

Thanks 7DW, like the sound of your plans especially the travel a bit more ... I'm glad things are moving ahead for you with sale I hope it concludes swiftly. I remember looking at the pics and thinking what a lovely place you have.. My son recently met someone 'special', and confided that if things go well he is thinking of buying a place across the border in Spain (he currently lives and works in Gib) so who knows I might have a place to stay in the near future.. then all I have to do is screw up my courage to drive in Spain again (I did it once and it did not go well). The new paperwork has been completed and registration is now complete.

Now all that has to happen is for the bank to value the property (for the third time ) and make our buyer his formal mortgage offer. His informal offer is still in date. Let's hope they don't change their mind.

Some more good news, we have had four house-sitting jobs come through from the agency today. One in Brmingham and three different ones for the same couple in Kidderminster. One has three dogs and one has two dogs and three cats. Looking forward to that, but a bit frit too.

Our buyer has been formally offered his mortgage!!:j:T:beer:
However.....the bank have done it for three grand less than the actual amount (well, this is Spain!), so the solicitor is hoping they can correct it swiftly tomorrow. :rotfl:We shall see. The Fat Lady is now clearing her throat and practising her scales.:)
If all goes well, completion should be the end of April, almost exactly a year after they first viewed the house.(AKA HRH_MUngo)
