    I think I'd just keep sending the account in dispute letter.

    I can't really see C1 or any dca litigating on this at the mo.

    You may just have to put up with the dca merrygoround for a bit.

    Just treat them with the contempt the idiots deserve...;)

    If you've not heard for a bit, then just leave it.

    Sorry, I try to help a lot of people on here and keep track of many threads, but sometimes I lose track of the odd one and what's happened and the progress...........;)

    I think I've posted in this thread before, but I keep track of so many that I need a reminder of whats happening, so I don't have to read through the entire thread again.

    Hi
    Just read your thread again and thought Id post
    I have had loads of probs with CAP1 and it wound me up for a year
    I got a reconstituted agreement,had various DCA chasing me at once complained to FOS (got nowhere)
    I tried to pay CAP1 direct because I was so confused but they kept returning my payments so I complained to CAP1 all they said was Credit Solutions would be in touch (they never have )
    Status now is I have not paid CAP1 since Sept 2010 (not for lack of trying)and if they should take me to court I have enough amo to defend
    I have never wanted to wriggle out of paying my debts(paying all my other creditors as per my DMP(self managed)
    So as you can see they dont always make it easy,but im not worrying about it anymore no doubt some poxy DCA will be in touch and I will just send a prove it as i believe CAP1 have no chance of taking me to court with their recon agreement they have just passed the debt for collection and not sold it on

    winner sounds identical

    im now thinking why should i keep paying c one my dmp amount per month as everything has gone quiet

    saying that they have never returned my monthly payments yet

    Sorry to ask but did you CCA Cap 1 or the DCA or both
    If Cap 1 are accepting your payment I would keep on paying them for now.
    Going down the route of not paying assuming its unenforceable is risky business these days but if they did take you to court it looks better for you and bad for them if you have tried to pay what you can afford but thats upto you to decide
