O2 have said the tarrif is no longer in existence, and have informed OTELO this. Well this is untrue and a breach of my T&C cos the tariff DOES/DID exist cos many other customers are still on it.
O2 SEEM TO THINK THEY CAN SAY SOMETHING IS NOT AVAILABLE AFTER WITHDRAWING IT.
BUT THEY SHOULD NOT HAVE WITHDRAWN IT FROM ME AND OTHERS IN THE FIRST INSTANCE.
SIMPLE AS............
O2 dont like the package as it represents a loss to them and they are pulling every trick in the book to wriggle out of the contracts.
Andy88 you obviously dont want to/ cannot claim compensation so I think this thread is no longer of any relevence to you, so stop trying to defend O2.0 -
Let's just consider something parallel as an example. Orange will compete with other providers with their Orange Value Promise, which means that they will match tariffs with other operators.
They used to offer an EQ Virgin tariff, but no longer do so. But customers on the tariff have not had their contracts cancelled. So the tariff still exists for those customers, but not new ones; an enquiry about a new one would be told that it is not available, but I don't imagine that they would say it never existed.
This O2 question is a bit similar; they have made the mistake of not allowing your permitted switch (I stick to my point that early enquiries of you were to discover more, but you rebutted them by treating people as stupid for asking).
You still seem to be in an argumentative mood, and your early posts refer to the Otelo result as provisional and your intention to escalate the dispute by alleging that O2 have corruptly presented false evidence.
If they told Otelo that the tariff never existed, you are right. If they said that it was never transferable, they are negligent - either they are deliberately intending to mislead, or some idiot there has picked up historic details which don't refer to the same deal (we seem to have discovered differences between ours).
So, as I already said, their refusal to allow your switch is wrong, but I believe that if you hope to increase your award of damages with further allegations you're taking a risk on something that's unlikely to be provable. My 50 minutes is only proof of their lying if they say it never existed, not if they won't switch
I'm not trying to defend O2. Merely pointing out that if you handle the case like this, they may have a counter case, that you have a hidden agenda to damage the company.
I think you should use the discovery that thefirs and I have the 50 minute deal, not as evidence of perjury, but to support a suggestion that they are mistaken. Mine does not appear to be switchable but you can be assured I will discuss it with them, and may endeavour to tell you the result as it could be useful - if mine is not and was a later version, then this is probably the source of their mistake talking to you (nobody there to realise the differences).
But if you're determined to have the same quality of argument with them that you show here, I don't foresee a happy ending. Do you want your contract switched or to achieve some heroic David vs Goliath result?0 -
A small question - did they write to you in advance to announce a forthcoming change in the Terms and Conditions, or did you discover it on ringing up to switch?
I strongly suspect the latter, judging by how aggrieved you are, and it seems much more likely that a large company would overlook things like this. This would tend to support a claim that they negligently failed to keep you informed.
But, though it is highly unlikely, if they did write in advance, you cannot say they are lying, only that you disagree with this unilateral change.0 -
Update - I had a brief chat with O2 CS.
Ordinary O2 CS do not have the history of the available contracts and tariffs in front of them, only the current one, and eventually a supervisor called me back.
After some discussion she told me that the Retentions dept have this and are the people to talk to, which seems surprising. At the moment they are claiming technical difficulties and I will call later0 -
Look andy88........I dont see what your comments are doing to add to this thread.
The issue is.
Holders of PUFFL contracts and specifically those entitlled to change between the two tarrifs as specified in their T&C are now entitled to compensation.
STOP CLOUDING THE ISSUE AND HIJACKING THE THREAD

I personally shall be endeavouring to ensure that the original T&C's are honoured as I am not interested in the £50 compensation.
Any pressure that can be brought upon O2 to achieve this is welcome.
If O2 come to realise that they my have to pay a lot of people compensation and not just me........it'll hurt them financially........and perhaps they'll think again about honouring the contract.
Then again perhaps O2 have done the maths and discovered that the payment of compensation will be cheaper in the long run than honouring the T&C's0 -

This complaint has already gone all the way to Robert Ramsden....chief complaint resolution case officer at O2 and a case officer at OTELO.
So a ring to O2 CS is a complete waste of time and money.You wait and see......may as well pick a wall to start banging your head against NOW!.....LOL.
If this precident applies to you......... BUT you've already indicated that is does not........When my complaint is finalisied you can write to OTELO and quote my case ref no as a precedent and hey presto.0 -

I did have interesting chats with 2 other offices at O2; I've spent about 50 minutes on the phone to them today; so take the !!!!!! out of me for wasting my time or decide whether I was trying to exert the extra pressure you mention.0 -
Hi Andy ........you will never get anything sorted by speaking to CS......they just dont have the power to deal with anything non standard like this.
I'll try to make clear my objectives.
1. I want the T&C's honoured by O2.
2. £50 is not enough compensation if the above is not achievable.
3. If forced to accept £50, then I'll ensure that everybody that is entitled to it gets it..........this may then make O2 reconsider........... because £50 to everybody thats entitled to it will be expensive for O2........they may be thinking that they will only have to pay it to me........and that would be cheap solution for O2, paying £50 to everyone is not.
I think the vast majority of PUFFL customers , like myself are not interested in the £50..........they want the T&C's honoured.
Andy88 do you have the Blue fold out leaflet with the T&C's.
Its states that when you buy the package you can choose between the 2 plans.....and importantly.......not to worry if you choose the wrong one......you may swap between the plans once a month for life.
This may have been removed from subsequent contracts in that it was seen by o2 to be too expensive for them.
This is the essential breach of T&C to which my case relates. If you cant find this condition / benefit in YOUR T&C's then you cannot claim.0 -
I think that they probably had different life time contracts available at different times. The one that I upgraded to in 2001in am sure I asked them if I could change to the other option of 50 minutes anytime if I choose the 200 minutes off peak, and I am pretty sure they said no you have to choose one or the other.
Also when I was trying to find out the cost of the calls last year everytime I phoned I was given a different answer, probably because the person I was speaking to at that particular time, looked at only one of the many contract options that had been offered over the time. So I ended up writing to them which I find usually works best, as the call centre operatives probably only have limited training in the job and are unlikely to know anything of past offeres.
I have now written to them again about the bill I received showing diffrent call charges than I was told previously. and whether I should be getting off peak X network included.0
