advice re rossendales and council tax

  • The accounts i have that i made an arrange ment with last year online state
    Debt:398.29
    Fees:106.30
    paid:95.80
    balance:408.79

    2nd account
    Debt:360.52
    fees:91.50
    paid_0.00

    the levvy for the above 2 accounts were made on goods of
    1.table and 2 chairs (these where purchased from ikea barealy cost £10)
    2. 2 seater sofa ( cost me £50)
    3.3 seater sofa ( also cost me £50)
    4. tv and stand ( its about 10 year old and packed in couple of weeks ago )
    5. stereo and hifi ( also not worth very much )

    both levys have the same items on which i signed and i have been paying £5 a week on since the bailiff came , which is a different one to who i am dealing with at the moment .
    No levvy for the account or paper work apart from the letter i copied on the above post stating the 24 hours and the 445 he had written on it .

    I paid using my mums card and she went to the bank not long after which is where she found out the full amount had been taken from her account

    I will do a complaint letter first thing in the morning even if he pays the money(phone him first thing and ask when/if he is going to pay it back and let me know) back your council need to be made aware that there bailiffs are Lying cheating bully's that don't work to the national standards for enforcement agents and i want to phone the Ministry of justice to check his certification

  • Thank you very much . i have sent the email to rossendales and have kept a copy too .
    I put his name in the web address you posted but it wouldnt come up with anything. I shall be ringing him first thing in the morning to find out whats happeneing with the money as it stands have no answers yet as he was supposed to call the same day to myself or my mum which he never did.

  • Today as confused me even more, I received an email from rossendales saying my offer had been refused , I sent an email last week asking if it could be passed back to my local council, they then stated after repayments of 24 a week every 7 days to be further confirmed, not sure where this amount has come from as when I rung was told arrangements couldn't be made with them.
    I then logged on to my internet account which showed the debt was now -65.00 and no longer with the bailliff , the debt amount was 380 and not 445 as the bailiff was trying to pass off which shows he was adding false costs.
    With the amount showing -65.00 this leaves me to believe that the money has been taken out in full as have not received no phone call to which will be ringing first thing in the morning.
    I'm still confused on why they are offering me 24.00 re payments weekly when the amount is in - 65.00 , I don't understand any of it to be honest
  • The balance which was -65.00 is nice 0 and for some reason they have added it onto the fee total which now stands at 270 for a 200 debt, also the money has not been refunded which was taken out of my mums card, we are ringing again today as didn't seem to get anyhere yesterday, any one have and thoughts of what t do?
  • The phonecall has been made and now have been told the bailiff in question is stating i told him to take the full amount out not the 200 which he did agree on , there now saying its his word against mine :(

    Unfortunately there is not alot you can do concerning him taking payment for the full amount.

    What you need to do is write to the council asking how much liability order was for?

    As pointed out by halowitch

    You will aslo need to contact the bailiff company asking for a breakdown of charges.

    They cannot charge 2 charges for 2 liability orders.

    If they levied 1st time on your goods they cannot levy on the same goods and charge you again for a different liability order.

    With the information that they send you, you can then if there are unlawful fees write back to bailiff company asking for payment of fees within a specific time.

    If not paid then a letter of complaint to council.

    If that fails then a letter before action to both bailiff company and council.

    If that fails then take both the council and bailiff company to small claim court, plus the local press.

    We really need to know figures dates times from both council and bailiff to be able to help futher.

    On another note are classed as

    NATIONAL STANDARDS FOR ENFORCEMENT AGENTS MAY 2002

    Those who might be potentially vulnerable include:
    • the elderly;
    • people with a disability;
    • the seriously ill;
    • the recently bereaved;
    • single parent families;
    • pregnant women;
    • unemployed people; and,
    • those who have obvious difficulty in understanding, speaking or reading English
    Also what they levied on might make it invalid as follows

    List A

    1) The following articles belonging to a debtor shall be exempt from distresslink3.gif at the instance of a creditor in respect of a debt due to him by the debtor-
    a) clothing reasonably required for the use of the debtor or any member of the debtor's household;
    b) implements, tools of trade, books or other equipment including a car or van reasonably required for the use of the debtor or any member of the debtor's household in the practice of the debtor's or such member's profession, trade or business, not exceeding in aggregate value £1,000 or such amount as may be prescribed in regulations made by the Lord Chancellor;
    c) medical aids or medical equipment reasonably required for the use of the debtor or any member of his household;
    d) books or other articles including a computer reasonably required for the education or training of the debtor or any member of the debtor's household not exceeding in aggregate value £1,000 or such amount as may be prescribed in regulations made by the Lord Chancellor;
    e) toys for the use of any child who is a member of the debtor's household;
    f) articles reasonably required for the care or upbringing of a child who is a member of the debtor's household.

    2) The following articles belonging to a debtor shall be exempt from distresslink3.gif if they are at the time of the distress in a dwellinghouse and are reasonably required for the use in the dwellinghouse of the person residing there or a member of the household-
    a) beds or bedding;
    b) household linen;
    c) chairs or settees;
    d) tables;
    e) food;
    f) lights or light fittings;
    g) heating appliances;
    h) curtains;
    i) floor coverings;
    j) furniture, equipment or utensils used for cooking storing or eating food;
    k) refrigerators;
    l) articles used for cleaning, mending, or pressing clothes;
    m) articles used for cleaning the dwellinghouse;
    n) furniture used for storing-
    (i) clothing, bedding or household linen;
    (ii) articles used for cleaning the dwellinghouse; or
    (iii) utensils used for cooking or eating food;

    o) articles used for safety in the dwellinghouse or of household articles
    3) The Lord Chancellor may by regulations add to the list set out in subsection (2) above, or delete or vary any of the items contained in that list.
    We consider that under 1(b) and 1(d) the preferable aggregate value might be £1500.

    Thereofre levy invalid on those grounds
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    This is what my online account says in relation to the bailiff i am dealing with at the moment.

    So you do not even owe £445 anyway.

    Please ring the Council now and ask them how much the liability order was for, including the court costs.
