1. Since the max I can reclaim in a small court procedure up here is £700-ish and I have statements going back many years with detailed charges well in excess of this amount, is it worth asking for charges going back 5 years?
2. If as I suspect the charges come to thousands should I take them to the big grown-up court to recover them?
3. I had to sell my house last year, new business struggling (recovered nicely now thankyou) and copped a swinging £5k get-out-of-mortgage-early charge. Now I know I signed the agreement but could this charge be deemed 'disproportionate' like the bank charges and if so could I try to recover it?
Thankyou for giving me the opportunity to have a crack at these bloodsuckers :T0 -
I'll shift this post into the Reclaiming in Scotland thread where you'll find users who are currently claiming in Scotland. One recently posted about putting in several small claims to keep it under the limit and the court told them they would all be heard together should it go that far.
Early Redemption Mortgage fees, no but read the Mortgage Board.

I have just sent my initial letter to the Nationwide bank, i know my charges incurred are in excess of £5500, however in Scotland small claims court will only pay out £750. Obvouisly breaking the claims down could amount to quite a big outlay. Does anyone know my best approach to this matter. Can i apply to a court in England? but again this has a limit of £5000.
Any help with this matter would be appreciated.
Good luck everyone
