I am really unsure about submitting several smaller claims now for my total of £4000.According to the CAG website some people have had their second claim thrown out of court because they have claimed before and some say it might be wiser to just claim the limit of £1500. Does anyone on here know any more about this? Should I claim the whole amount and risk going to court and having costs awarded against me?0

First of all what stage are you at? Have you submitted a claim for your charges yet? Are you at the court stage now?0

If you were talking to me Edinburghlass I am sitting with my 14 day letter and list of charges ready to post. I've already decided to forfeit some money by only claiming what I could find in charges on internet banking which only goes back to July 2002 and really don't want to claim for less than the full £4000. The letter I am sending does claim for the full amount but if/when it gets to court stage I will need to decide to settle for less with less risk or go for it with more risk. It's LTSB I'm claimig against who seem to drag things out as long as they can.0

Next question is what bank? Fire your claim in now and we'll worry about the court stage when/if you come it.

McGEEK - The small claims limit is actualy £750 however you can do a Summary Cause where the limit is £1500. The fee is the same, £39 and as far as I know the procedure is similar to a small claims.
HARIBOJUNKIE - Just a thought, is this a joint account cos if it was perhaps you could do one claim for say 2002 - 2004 then your partner could do 2004 - 2007 or something like that....??? If not then you will need to make 3 different claims...hopefully your bank will pay up before it comes to that.0 -

New to this site and boards.
I have sent off my first letter to Lloyds TSB. I have not had a reply and not sure what my next step is. Can anyone help? Also I Live in Scotland and not toosure if there are any different laws here which may stop or hinder me from doing this, does anyone know?0 -
