    What I would say is while its a good idea to read up what you can don't worry about going to court just yet as when it comes to that point you may well receive an offer that you could accept without the hassle of going to court.
  • Hi, I now live in Scotland but opened the account whilst living in England what are the rules relating to how much maximum I can claim through the "small claims court & OR Scottish court" as I believe that their is a huge difference between the 2. Please advise.:mad:

    Having watched the programme last night I have decided to follow this up and claim my excessive bank charges.

    However I am having a problem of which law do I follow, with me living in Scotland but the addresses I have for both Lloyds TSB and Bank of Scotland are a PO box number I suspect is not in Scotland for Lloyds and an address in the channel islands for the Bank of Scotland.

    Do I follow scots law as I am in Scotland? or English law as this is where I suspect they are based.

    Or does anyone have other addresses for which my request for DPA info should be requested at.

  • Check the addresses for the DPA letter in the first post in the Reclaim Help Thread and have a read of the links above to Govan Law Centre.
  • So let's see if I got this right, before taking on the man.
    - Got 3 accounts with the Halifax Plc (checked the registered address on our statements which is Halix england)
    - We live in Edinburgh.
    - The amount of charges is probably more than 1500 quid (or perhaps there abouts)
    - got relatives living in England whose address we can use
    - According http://www.govanlc.com/jurisdiction.htm when/if it comes to court proceedings we can either use a Scottish or an English local court.
    - since the amount owed to us is more than 1500, we best of using the englsih https://www.moneyclaim.gov.uk (of course if it does come this far)
    - travel is no objection. (always wanted to see Halifax..:) )

    i think that cvers it non?

    As i am claiming just over £5000.00 and need to split into 4 when I go to court as I am in Scotland I am about to send my second letter to The Bank Of Scotland threatening court action so should i send the bank 4 letters stating th 4 different amounts aswell :confused:
  • No, send the one letter with your claim as at the end of the day you are really hoping that you won't need to take them to court.

    Its only when you have to actually file at the courts that you would split up your claim.

    Have a read of the post by Squeekclean above where he explains his large claim.

    Really do hope that someone can help us, we are trying to claim back £2128 through The Bank Of Scotland, so far we have sent two letters with the next one being court actions, but living in Scotland, we have noticed you can only claim for £750, we really are totally confused, and need some help regarding what correct actions to take..
