I am attempting to claim £1,000 back from Halifax Credit Cards. Their address is in Scotland. It appears i cannot claim through the English small claims court, even though this is an English company.
Is there any way around this???????

Where do you live? If you live in England use the registered address for Halifax, the address in Scotland is the credit card call centre.

Hiya all,
I've sent off my first letter to the bank on 5th Jan this year, recieved two letters now basically stalling for time. First one told me they'd reply within 4 weeks, second sent to me on 2nd Feb, said i'd hear from them by 2nd march!
Anyway i called them today and informed them i wanted a satisfactory reply by end of next working day, or I was taking them to court. The advisor informed me that they have 40 days to reply, so i informed her they manage fine to respond to my account being overdrawn within 24 hours, and are efficient enough at taking unlawful cash from my account only 7 days after that!
Anyway, as i'm from Scotland, and claiming £3009 plus interest, what is my next step as i'm confused. Plus could anyone advise where i can find legal experts who specialise in this area?

Hi I'm new to all this and acting on behalf of my son. I have 3 main questions:
1. As he is asking for ststements from 3 bank accounts does he have to include a cheque for £10 or £30 ?(Had conflicting replies for this)
2. His address has now changed - should he tell them original address when asking for statements or are account numbers enough?
3. He reckons he may need to take out an ordinary action which requires a solicitor. If the bank pays up before it actually goes to court, who pays solicitor fees?

One cheque for £10 for three accounts at the same bank will do. Provided he has the account numbers he shouldn't need to give the addresses but I would ensure the bank knows his current address is against each of the accounts.
He would need to pay any solicitor.

Hi folks
Not been on for a while, been busy but this is an update.
I found it really hard to find information about what to do after sending the last letter, yes the going to court part.
This is where I have got to so far.
Got the forms from the court, decided it was a bit much to sit down and divide these up into £750, the small claims limit so went for the Summary Cause which has a limit of £1500, well actually took three of these and a small claims also as my claim amounts to over £5000.
I asked at the time if I could request all of these to be heard at the same time and was told they probably would be as they all had my name and address and would be handled at the same time.
Today I received my forms back but don't be alarmed as this is procedure, court date 23rd March 2007 @ 10am.
I now have to get a Sheriff Officer to send them to the Bank of Scotland, all the claims have the same date and time so I guess they will all be heard at the same time, If it gets that far.
The forms themself are a bit confusing if you have never filled any in before but don't let that put you off, If you need advice come back to this website.
I will take my forms to be sent to the bank to the Sheriff Officer tomorrow and cross my fingers.
I don't think even a phone call from the bank offering some of the money can stop me now, I've taken it this far, let's go all the way.
I'm now looking for the full amount and interest, I may have settled for a lesser amount if the bank had been less obstuctive.
Just seen a woman on TV who claimed back £16,000, well done to her for going for it.
