Reclaiming in Scotland

    I have just recived my second letter from the Nationwide refusing again to pay back the charges I have on my account. Just to let everyone know where I stand I have not been in employment for the past 2 years due to stopping work to look after my terminally ill father. Over these 2 years even though the bank knew of my situation I have been charged over £2000. I have sent them 2 letters now asking for them to pay these charges back and have been turned down twice. I also sent an complaint e-mail last night due to yet another £240 worth of charges added to my account yesterday which means my mortgage went unpaid again, I also still have over £1000 to pay towards a funeral and my electricity bill is overdue about £450. This bank is robbing me dry and I am now getting really worried about losing everything because of these rediculous bank charges. I have just started working again on Monday so at least I will have some money coming in again. But my main question is what can I do now, I am aware about going down the court route but am worried about having to pay for this and losing as I really can't afford any outgoings at the moment at all, as I live in Scotland I can only claim £750 at a time but have now idea how to go about this or where to start to make a claim?
    I have already posted over on CAG but never got any response.
    Sorry for the huge rant but any help would be great.

    Go to the Scottish section and it will give you a step by step guide to claiming in Scotland. It also gives you pre filled court forms. You only insert your own details. It's really easy to understand as it's people who live in Scotland who know a lot about Scottish law that advise and they have done it all before us.

    I must say tho, I only found the site through this one, which I think is brill.

  • i live in scotland and want to claim more than the £750 allowed in the small claims court my bank is abbey can anyone advice me ?
  • Check out the links above to Govan Law Centre and PenaltyCharges which have a great deal of help for claiming in Scotland.
  • During my initial demand letters to the bank I asked for the full amount I am owed. £1640 plus interest of £400ish.
    I then split my claim into 1 summary cause and 1 small claims at court stage. Both the Summary cause and small claim return day are on the same day. I included copies of the original letters for the full amount with both claims.

    From reading up on this apparently banks lawyers can argue that this is a "abuse of process". Is there any threads on here where someone has been through this? I am lost. I followed all the instructions on MSE and other websites. :confused:

    Does anyone out there have any experience of this? Does this mean my claim will be thrown out? Have I lost my claim by doing this claim splitting?

    Help! Any advice/thoughts appreciated.

  • I recently read that the maximum amount of money that can be claimed for in a Scottish small claims court is £750. This worried me as the charges I should get back are will in excess of £2,000.

    Is there another way I can claim through the courts if the bank refuses to pay up?
