It seems like such a waste of time, paperwork and effort sending out all the letters etc.

It's not a waste of time for the banks. The time, the more paperwork the more effort there is the more they save money because people give it up as a bad job.

The people who use the facilities here and other reclaim websites are a small fraction of the people who try to claim. The rest get discouraged by the hurdles in front of them and gradually fall by the wayside.
Hamsters have no tact and diplomacy, nor do they want any.

I have just finally got through to someone with a name who can send my charges. (been trying since 17th APril). Anyway, this person send she will send me a list of the charges (not statements). Is this the norm for FIrst DIrect or is it just another name for statements and I will have to trawl through 4 years and 3 accounts worth.

Also I am wondering if a refund of charges is made, how does this affect mymortgage, as the old current account balance was transferred onto the mortgage to reduce our outstanding balance. Does this mean they have to deduct it off the mortgage as well????????????????????????????

    Any advice appreciated. Thanks

    SUCCESS!!!!!!!!!!!!!!!!!!!!!!!!

This very nice lady, actually did as promised and sent my statements straight away. I trawled through them (not done mortgage yet), and found it came to £2000. I faxed the list over to her, but still sent a copy recorded delivery just in case. That was on Tuesday. Today I received an offer of £1623. This is a good figure and If I could get £1800 would be over the moon, but dont want to jeopardise by it going to court.

What are other peoples experiences when receiving an offer? Are they good to negotiate on the phone????????

Decided to accept the offer. Was told as the account was no longer operating - it was not actually closed. They would pay the funds in and I can then make arrangements to go and withdraw this from a local branch.

I also made it clear on the phone that this was only for the current account as i had not had statements for the mortgage account yet. The letter I had to sign did say in full and final settlement claim against the bank - but they had listed the account number above it.

I sent a fax with it stating that I was accepting this offer for the personal accounts but not the mortgage as well.

been offered £460 after a claim for £520, and i have decided to accept, they however state that the money will be paid into my account...(even though they closed my account a month ago) how would i get the money paid to me by cheque?

is it worth phoning them up and asking? if so does anyone have a direct line number for
Robert Kernaghan, Customer Relations Manager or
    Melanie Dyson, customer services manager?

    thanks all

  • Apologies to the admins for not finding the specific thread to place this in...but there are so many...and I just wanted to add a little help.

Anyone trying to reclaim from First Direct: Just phone them up and ask for your 6 years worth of statements. They DHL'd mine to me within a week. I sent the letter the next day and received an offer within 7 days.

I claimed £1532.50 plus around £300 interest (only for negotiation purposes). They've offered me £1290. The whole process has taken no more than 2 weeks and they were extremely helpful and not all unpleasant. Obviously, they ought to be as they shouldn't have done it in the first place...but, as ever, their customer service has been spot on.

    Good luck with them...:-)

Maybe they've learned something from their introduction of a monthly fee and mass exodus of customers.
The acquisition of wealth is no longer the driving force in my life. :)
  • Hello All,

I am new to chatting, technology and this reclaiming business. I have followed up so far with two accounts I have with First Direct and they
point blank refuse to pay or negotiate.

I have had no alternative but to go to the Ombudsman - posted letters
    yesterday and fingers are crossed.

Am claiming just over £4000 from one account and just over £5000 from the other account.

Has anyone had any joy from this institute that calls itself a bank???

  • I have just made two complaints against First Direct to the Ombudsman,
letters posted yesterday and am now waiting for a reply. It could take upto 3 months they say.
Am also proud to be dealing with debt and reducing it.
    GOOD LUCK to us !!!

  • I am waiting to reclaim my money and then I'm walking to,
bring back the days of honest banking - if there was any such thing!

  • Hi there,

I just got a response from First Direct who are offering me a quick settlement!!

They're offering #1105.50. Excluding #174.00 of charges applied on the 7 June, of which I find very ironic as the account was closed in May.

The point of this post is to say that I had made a claim for #1300+ and just wanted to hear your thoughts on this matter.

    Thanks and best of British...
    rob:cool:

Below is part of the letter:

    "Without Prejudice

    "Dear X

"Thank you for your letter dated 12 June requesting a refund of bank charges.

"In circumstances where you have authorised a payment that would, if met by us, lead to your account going overdrawn or to exceed an agreed overdraft limit, we have to consider whether to make this payment. A fee is payable for this service provided by the bank, details of which are clearly set out in our published tarriff. The circumstances in which the fee will appy are clearly set out in our Account Terms and Condtions, a copy of which was provided to you when you popened you account. We are confident of our position and believe that if your claim for a refund proceeded to Court, we would successfully resist any legal challenge in relation to these fees.

"first direct is, however, mindful of the management time and irrecoverable legal costs we may incur in relation to such a claim. For those commercial reasons alone, and without any admission of liability whatsoever, first direct is prepared to make payment to you in the sum of #1105.50 in full and final settlement of your claim. This amounts includes 174.00 of charges applied on 7 June. "

    ....yada...yada...yaha.......
