    Amount claimed £1436 plus interest = £1587.56
    Amount offered £1220 - holding out for full amount

    I'm claiming for my son, I filed a claim with MCOL and he has just received a 'Notice of Transfer of Procceedings' They waited until the 28th day to file their defence! So I guess we now we wait to hear from Bournemouth County Court with a date. Can someone who has gone this far with First Direct let us know what to expect next? Should we expect to hear from FD's solicitors? I'm expecting them to wait until the day before the court date before offering the total amount.
    I also got to this stage, and have been waiting 5 weeks for the courts to set a date. FD's solictors wrote to me last week asking me to detail my charges, what they were for and interest amount. I sent this info to them, and then 4 days later I got my offer in full, plus interest, plus court fees. Keep with it, they'll offer you the money.

    04/04/07 Requested statements by phone - faster
    23/04/07 Statements arrived
    02/05/07 April statements arrived - they were posted out on 21/04/07
    04/05/07 Posted letter asking for refund of £490
    09/05/07 (2 working days later!) Received an offer of £438 which is 85% (as they have included another pending charge of £25).
    85% seems to be a percentage they like to offer! which suggests they are saying it only costs them 15% of what they are actually charging in the first place!
    Now deciding what to do. :think:
    Have noticed though they have reduced their excess overdraft fee to £50 when it was £75 at one point!

    They seem to be really fast. I have a friend who wrote to the Halifax on 26 Feb asking for copy statements for 6 years and she is still waiting as they only sent a list of charges for 3 years - not even statements! 72 days so far, she is fuming but powerless :(

    Anyone got any idea how long FD take to transfer the money into your account once you have accepted their offer?
    Its been a week now and still no funds. I'm not impatient, its just I thought FD were quick at this sort of thing.

    Also, I've been thinking about the longer term effects of these charges. If we're all claiming the charges back under the guise that they are unlawful, why aren't FD and all the other banks for that matter either reducing their charges or changing their T&C's??
    If we run into trouble again with overdrafts etc, then they are only going to charge us the same amount again! The we claim it back again! It seems like a vicious circle!

  • I used to be with first direct until my husband lost his job a couple of years ago and we had to survive on one wage, we got in a mess, the bank was NO HELP and they eventually closed my account. Anyway now we are sorted and i am more confident with dealing with them now (this website helps!).
    i asked for my statements, got them today and have just worked out all my charges and it comes to £3500.00 !!!!

    i can;t believe the figure was so high and it makes me really angry....i am sending my letter now to ask for the money back.

    ps..the bank i am with now have tried to charge me twice and i argued both times and got them refunded straight away (even thought the 1st refund stated that it would be a "one-off"!!)

    pps.. now try to be really careful with money and no longer have an overdraft (sorry to be smug but am proud of this and the fact the bank can;t charge me or get money off me this way anymore is my incentive!)

    love the fact we are all fighting back.!

    banks only seem to want to help you when you have money.

    Hi All

    Just starting my claim with First Direct. wrote to them on 15 April requesting Statements enclosing a £10 cheque. had that returned on 28 April saying that this service was free of charge - have received statements via DHL today. Will be spending weekend trawling them and compiling charges will let evry1 know how I get on - good luck to everybody and what a fantastic site this is - nice to see the Public rising up and getting back what has been wrongfully taken by the Banks.

    I have a claim against First Direct too. I had breast cancer about 4 years ago and was off work for 9 months. First Direct charged me bank charges for being overdrawn etc for the whole period I was off work despite my writing to them to tell them I may not be well enough to administer my account.

    Their solution was that they would text my mobile if I was in the red - for the next 6 months I got pure advertising from them which came through in the middle of the night, waking the whole household up. It took several nasty letters from my husband to stop them sending me texts.

    However, "revenge is sweet" as they say, I am at the Court stage now, they have put in the usual defence and the case is about to be listed, however the Court told me yesterday that it would not be listed until the end of August yesterday! Good luck with your claim !
  • Just checked my balance online to find £700 in there listed as "Charges Refund". My original claim was for £766, and they first offered £567, which I told them where to stick :p
    Was going to take it all the way to court, but going on holiday in 2 weeks and the money will come in very handy!
    Thanks very much FD, I'll be off to someone offering a much higher interest rate now I've had my money back.

    I can't decide if i'm able claim both

    "Overdraft fee" - usually a set fee of 30 pounds

    as well as

    "Excess Overdraft fee" - which seems to be anything first direct would like to charge.

    I can see that this question has been asked on a couple of other occasions by different prople but don't seem to be able to see an answer.

    Please can someone help me with this as it will make a big difference to how much the claim will be.

    I had Overdraft and Excess Overdraft fees, and claimed for it all, and got most of it too!!
    See 2 posts up!!
    Put all the fees into the calculator on this site, and claim the full amount.
    Its up to you if want to claim interest or not, but in my experience FD will not take that into consideration in the early stages, so maybe just claim the amount without interest. if they follow the pattern they have with most of the other fine folks on here, they will write back and make you an offer, somewhere in the region of 50-75% of the total.
    I claimed £766, and the first offer was £567, which they said would be 'full and final'.
    I refused it, and advised them of impending court action. They then wrote back and offered £700, which I accepted.
    The money was in my account 10 days later.
