    I got my offer from First Direct today, I claimed for £530 and they offered £360, I can't be asked to hold out for more so the acceptance letter went off today
  • Well we are 4 months down the road now and have just received a 'Notice of transfer of Proceedings' from the courts after FD entered a defence online. The case has been transferred from Northampton County Court to our local court in Dewsbury. The form talks about 'the filing of an allocation questionnaire' and an 'allocation fee' that may be payable. However, they have not included a questionnaire or told us how much the fee will be or even if we have to pay one.

    Has anybody had a similar experience and do you have any advice for us on what to do next? It's getting a little scary now, especially following the news that a judge in Birmingham has ruled in favour of one of the banks.

    Does anyone know what the next part of the process will be and is there anyone that has been to court in Dewsbury and been successful?

    The allocation questionnaire is sent out to both parties. It is fairly self explanatory, and asks questions like 'is there any reason why the claim should be moved to a different court', 'do you wish to seek particular directions for the conduct of the case' and so on.

    The fee must be paid when you return the questionnaire, and is -

    claims for money of £1,500 or less no fee
    all other claims £100

    When you win, the bank will have to pay your court fees on top of the money owed and the interest.

    Yes they do.

    Also on this subject - I used to work for FD and have friends who still do. Apparently they have a new team set up purely to deal with refunding bank charges because of this campaign! :rotfl:

    I have just finally got through to someone with a name who can send my charges. (been trying since 17th APril). Anyway, this person send she will send me a list of the charges (not statements). Is this the norm for FIrst DIrect or is it just another name for statements and I will have to trawl through 4 years and 3 accounts worth.

    Also I am wondering if a refund of charges is made, how does this affect mymortgage, as the old current account balance was transferred onto the mortgage to reduce our outstanding balance. Does this mean they have to deduct it off the mortgage as well????????????????????????????

    Have just discovered that 1st Direct have entered a defence to my claim on moneyclaim.gov.uk :(

    Guess I'm now going to have to go through all the hassle of preparing the court bundle etc. What I want to know is how many of you have actually gone through the whole process ...

    ... do the banks show up?
    ... if they do, how agressive/intimidating are the actual court proceedings?
    ... if they don't, what happens at court then? Do you still have to argue your case?

    For those of us who've got it all too look forward to, it would be really encouraging (I hope!) to hear from some of you who've actually been there, done that and got the t-shirt!

    You will hear from the court what they want next or you may hear from the bank/solicitor first asking for further information.

  • This is my first post, so apologies for errors/omissions:

    I followed your instructions to the letter and first direct sent me six years' statements. I calculated that, with interest, they owed me £906.57 (£715.00 without).

    I'm in a debt management plan with Payplan and owe FD £14000, paying £35 a month back.

    FD have offered today £600.00 Should I settle or push on? Will my debt default count against me?

    Its very likely that that FD will pay any monies reclaimed towards the debt held so you might like to take that into account when making your decision.

    Well i've got my date for Court EEEEEEKKKKK!!!!!
    3rd of august is my date for First Direct.
    I'm sure it wont be that bad, its just like a conveyor belt of the same thing for the court people. I'm in with 6 other people.
    I'm kinda hoping they may decide to pay up before the court date. Its no wonder that the court people get miffed if this is what happens. It seems like such a waste of time, paperwork and effort sending out all the letters etc.
