Personally I would not accept there offer, they made me an offer against my claim, which I refused, filed a court claim against them, which they put a defence against, last week i got an offer letter for the full amout of my claim minus 80.00, which they said was out of the six years time frame. It is worth hanging out for the full amount, they will pay up in the end, :beer: go for it !!

Originaly i ask for £1089(826+263 int) they are offerin me 640.00.I don't want to accept this offer . can anybody help with the next letter? will that be the court one ? please help, i realy want to see if they will pay off. thank you0 -
It took a couple of days from receipt of the letter for my statements to arrive by courier, which was DHL. I have claimed for overdraft fee, excess overdraft fee and interest on these charges. Use the calculator off this site to work this out. I only had 2 yrs worth, it make take a bit longer to get the full 6 yrs worth.
They are offerin me 640.00 wich i dont want to take. I d'ont know how to write the letter, shall i just write that I refuse or I need to sent one of Martins template for the court.

After Edinburghlass's excellent advice I have today refused the offer First Direct made of £340 versus the £415 I was asking for. I wrote back and said that I did not accept their offer and that I wanted a full refund - I then made this the letter before action and warned them that I would take the matter to court within 14 days of today if they do not respond satisfactorily in that time. I also reminded them that if it went to Court they might also incur the interest cost and court fees - I felt like I was being as bullying as they are by saying this - but I think it is all part of the dance. I'll post on this thread if I receive a reply.0

For my sins I am ex FD staff and the £37.50 item is when something i.e. a cheque or a direct debit has been returned by a department due to insufficent avaliable funds. This means money physically there. So if you have a cheque in you bank they may still return items.

I seem to remeber they can't warrant these charges all it requires is pressing a few butoons to return it. Which is about 10 minutes of the staff time and maybe 2/3 phonecalls0

Usually depends on if the account is closed or not.
If the account is closed then the bank will most likely pay by cheque. Although in some circumstances they have been known to pay the reclaimed charges direct to the DCA.
Although if you get to the stage where you have commenced legal proceedings then if you win your case they can only repay you by cheque anyway.
Also, if they wish to settle outside of court, which 99% of the time they do, you can stipulate how you want refunding in order for you to drop the case.0 -

I received the acknowledgement of my letter last Tuesday (13th) saying they would get my statements out to me but I've still not received anything (today is the 23rd).
Should I be concerned? (My statement request letter was sent on the 9th)
