    I wonder if the money is being thought of as a windfall.See this on standard IVA terms.

    IVA Procedure:  changes in your circumstances – windfalls
    
    The same rules apply to any windfalls you receive during the IVA. A windfall is an unexpected payment, such as an inheritance or a lottery win. If the windfall is of a modest sum, you will be expected to pay half of it to your Supervisor (who will add it to the creditor pot). If however you receive a massive windfall – enough to pay your creditors in full – you would be expected to pay a sum over to the Supervisor that would allow your creditors to get paid their money back in full. Once again, it’s only fair.
    
    As with pay reviews, the windfall rule will be a condition of the IVA – so if you fail to tell your Supervisor about the windfall the IVA can be cancelled.

    My claim is now with MCOL and they have 'acknowledged' the claim, so have until the 2nd of April (by my calculations - 28days from serving the claim) to put in a defence.

    What's the general outcome for people who've got to this stage with First Direct?
  • I am at the Allocation Questionnaire stage. Briefly, I am claiming £2,300 plus £600 interest. After my first letter they offered £1,985. Second letter their offer was for the full amount of £2,300. I went ahead with MOC to claim the interest. They filed their Acknowledgement of Service requesting a further 28 days. On day 21 I was notified that they were defending the claim and that I had to return the Allocation Questionnaire. This has been sent to my local court today (with a further court fee of £100) - it seems that the court now sets the date which can be anything from now to 4 months time!

  • I sent my statement request letter to 40 Wakefield Road and got my statements back within 10 days. They didn't charge either.

    Hi All
    LOve this site, finally plucked up the courage to get my statements from FD, did it via email and though it took a while, about 10 days, they arrived this morning.
    Although realised i made a mistake and requested only 5 years. Anyway have spent this afternoon going through them and found that we have been charged £6158(no interest) in 5 years, was completely amazed.
    My first letter is now ready to go in the post in the morning, gonna send it recorded just to be sure.
    It's pretty scary as most of the posts on here are for a couple of £1000 at most. Anyone got anywhere with claiming large amounts from FD?

    Hi everyone. Need a bit of advice.

    Just recd a letter from First Direct offering £726 of a claim i put in for £1105.34 (inc Interest), which is just over 65% of my claim.

    They have stated in the letter, however, that if i accept the payment as a full and final settlement, they will arrange for the debt management company dealing with the account, to debit the refund from the balance outstanding.

    My query is, can they state that i have to use the refund to pay off part of the debt? They dont know if i have mortgage arrears or council tax arrears, or something which i deem to be a more urgent debt than their own.

    I think i will continue through the court system anyway as i am not happy to accept only 65%. But assuming i take them to court and win as i did with A&L who sent me a cheque for the refund, can they still state that i must pay the money off my debt??
