    I got a letter yesterday from Alliance and Leicetsre AKA MBNA. I am already taking them court, their 28 days being up on 13th April and they have responded to a letter that was sent ages ago (2 more sent since), and they say they have also refunded £48 to my account.
    They state:

    "you may know that the Office of Fair Trading has recentlyu issued guidelines for the level of credit card default charges. MBNA disagrees with the OFT's interpretation of the law and continues to maintain that its default charges have always been fair, legal and trasnparent. However, we have decided to reduce our default charges to £12 with effect from 28 June for late payments and returned payments, and 28 July for overlimit fees.

    With the above in mind, and as a gesture of goodwill, i have creditted your account with a payment of £48, this will be deducted from your outstanding balance."

    I requested my statements online and heard nothing for 3 weeks. Phoned them and asked if there were coming. The lady re-oreded them and they arrived in a couple of days by DHL.

    I have about £920 to claim.

    Letter done. I just need to create a page summarizing all the dates and fees and hopefully...:beer:
  • They are allowed 40 days after receiving your data request to send the statements, if you have not received them by then, write again stating they have not complied with your Subject Access Request and give them a further 7 days or you will report them to the Information Commissioner for non-compliance. As it has only been a month you will have to wait a bit longer. Dont worry if one cheque hasnt been cashed, you can track the delivery on-line to prove whether or not they received the letter and see who signed for it.

    I have been succesful in reclaiming al my bacnk charges to the total of 2700. First Direct have just sent me a letter offering me £879.00 back from when i was with them a couple of years ago. As i went to sign it onthe second page, in the small print it said that i accept that the total refund will go straight to teh debt collectors i owe money to! I am currently paying these debt collectors back monthly. The reason i had my account closed in the first place was because of all these charges now they are telling me how to spend my refund! I am quite willing to pay the debt collectors, not that it has anything to do with first direct anymore, but i want to go to them myself and request a settlement figure which will clear the debt totally. If FD just pass them the money (my money they took from me illegally in the first place) ive lost that oportunity.
    I have said all this to FD and they said that that is the terms on which they will repay the charges. I have sent the offer back saying that i accept that amount as a refund as long as it comes straight to me otherwise i will claim the full amount via the courts including interest and court costs.
    i hav nothing to lose now as it wont come direct to me anyway.

    Has anyone else encountered anything like this? Also are FD allowed to tell me how to spend the refund if the debt has been sold on ?

    Being charged for "Not paying by DD" is unfair and you can claim it.

    So can people who get charged for paying by DD. Altogether for paying through a customer's preferred method cannot be charged.

    I have attached two templete letters I found on BBC. Use whichever you need.

    I have 3 bank accounts (my wife has another 2!) which must have thousands of pounds of charges over the last 6 years, and I also have 9 credit cards which I'm trying to clear and have had loads of charges on, so I've got my work cut out!!! I need some good organisational skills for this!!! :p

    But I've just heard back from First Direct regarding my request for charges (statements) and they have returned my cheque stating all statements for the last 6 years will be provided FREE OF CHARGE!

    I feel like I had some success already!!! ;)
  • Hi, I want to claim back my First Direct charges but have a bank account and mortgage with HSBC. Will HSBC being the parent group close my HSBC account down and cancel my mortgage is I try to claim the charges back? Please help!!!

  • I've looked, but can't find anything specificly relating to parent groups etc or mortgages... advice would be appriciated...
