This is what it says.Thank you for contacting us about charges incurred on your flexaccount. Unfortunately we are unable to refund the charges as you've requested.
As you'll be aware if an item is paid, which takes you over your agreed overdraft limit, we'll issue you with a charge. This also applies if an item is returned unpaid on your account. These charges are in accordance with the terms and conditions to which you agreed to when you signed the application form to open your account.
Do I still go ahead with the court claims, or does this mean I will probably lose? Any advice please.

Of course you still go ahead! Their letter is the usual blurb, trying to make you chicken out. Send the next letter and then file the claim if necessary. But be advised that Nationwide tends to close accounts of people who successfully claimed so open another account soon!Reclaimed thanks to this site:

Just a question regarding Nationwides policy at the moment
I am in the process of claiming back charges from banks and credit cards (managed to get back about £1250 so far and still have more to claim!)
Anyhow, whilst I have been doing this, my current bank, Nationwide, who up until now I had no issues with, have hit me with 3 x £30 charges for refused Direct Debits & Standing Orders. I have had no previous charges with them as nowadays I am a lot more organised with my money. (The charges were the result of a !!!!-up – partly my fault, partly third-party company trying to take money out when they shouldn’t have.)
Obviously, as I am quite well versed regarding the whole claiming back charges issue, I firstly rang them up to try and persuade them politely to refund them.
Interestingly, polite as they were, they are saying now that Nationwide is point blank refusing to refund any charges (unless it is an error by Nationwide) they apparently have adopted this policy since Oct 05 (although I am sure they have paid out to people since that date) and they haven’t even altered their charges down to £12. I made several phonecalls at different times and spoke to both customer service bods and supervisors but they all seem to be singing from the same song sheet.
I imagine its all bulls**t and that Nationwide will pay out like the rest, but I thought I best check that nothing has changed that I don’t know about. They are my current bank and its only £90. As (apart from this) I like banking with them, I may let it go (charges are over 2 months span) as I have plenty of bigger fish to fry so to speak.
As a precaution though, I am also in process of opening parachute account.
What do you folks think?

Nationwide have recently stung me and £30 per time is so excessive. I havent put any money into the account as I dont intend to give them this money so wont have to claim it back.
I am wanting to open a new account and wondered which was the best bank for someone with a poor recent credit rating? I read about a company somewhere on her that may even give me a current account but cant find the thread now.0 -
I have recived a letter from nationwide saying they have studied all my charges I have incurred in the last 4 years. I calcultaed it to be around £800. I have recived the court fees back and a mysterious payment of £450. Is this all I will get or can I hang em out to dry??
Similarly i just checked my online banking and my claim of in excess of £5000 I have been credited £4000. Should I be content with this???
I have not been asked to close my account which is unusual for Nationwide.
Do I need to do anything with MCOL to stop or continue with the claim??

hi, was wondering if anyone could tell me how long on average nationwide take to send back bank statements? it has only been 10 days, but very impatient as want to see how much they total!!!
also, due to periods of not working due to ill health, have quite a poor credit rating, but still managed to open a halifax easycash account, with electron debit card, so if like me, people are scared to reclaim due to panic over opening new account, it can be done!!!!0
