    Can some one assist, I have a Nat West Student/Graduate account and I am £1573 over drawn, they have charged me £1537 in bank charges in the past 3 years, if I get my charges back this would virtually clear my debt, I have read through the site and cant find many people who have been successful with Nat West, I am worried that they might close my account and demand the money I am over drawn if I start the claim, your general thoughts please. :rolleyes:

  • I sent my 2nd letter in on thursday to the branch handed in person saying they had 7 days to refund my charges of £2936 i have chased them today as the call centre said they would reply within 24 hours, they are now saying they have sent it over to the lending team and because they are receiving so many of these letters and will send out an acknoledgement by the ebd of the month !!!!
    any ideas on how to push this forward ?

    Also should i issue the court warnings on thurs if i havent heard anything ?

    Do not waste time chasing them. Just stick to your timetable and file the claim when your specified period is up.

    Have now replied to Cobbetts and have sent off the allocation questionnaire today. My first thought was 'why should I give them any information?'. It turns out that it their request does not apply as I have learnt from another forum on this topic.....

    To Cobbetts I wrote


    the information you requested under CPR Part 18, the guidance that I have received indicates that CPR Part 18 does not apply to the small claims track and is therefore irrelevant in this case. I am sure that you are already aware of this and I can therefore only conclude that the inquiry was intended to intimidate. As such I intend to bring this intimidation to the notice of the court.

    Sent my letter to my local Natwest on 21st November 2006 along with a cheque for £10 requesting statements for six years. On the 24th November my 10 pound cheque was cleared back into my natwest account which I don't use anymore. I sent another letter on 2nd Janaury 2007 to Alex Lyon in Edinburgh by recorded requesting statements by 8th January then they would be reported to the information commissioner. Not heard anything again today so phoned regulatory risk and was told that the second letter hadn't been received. When I told her it had been delivered by recorded delivery (I checked royal mail website with my reference number) she went quiet and put me in hold. When she came back on the line I was told that she would look into it today and phone me.

    Someone has told me to report to information commissioner if i've not heard anything by the end of the day.

    Can I still claim from Natwest when I have done this.

    Hi everyone and Happy New Year to you all.

    I have a problem with NatWest again so I will try and keep it short and hopefully someone will be able to offer me some advice.

    I applied to Nat West back in April regarding my charges on two accounts got letter back on both accounts saying would not pay up, at the time I had rather more pressing stuff going on to worry about following this on.

    So in December I wrote to them again asking for my money back to my surprise I got a letter in the new year offering me £850.93 I checked my records and I had put a claim in for £650 and £2194.77

    The first letter I received late December was advising that they would refund all unarranged borrowing card misuse paid referal fees accrued and as a gesture of good will and without admission of liability or error and the charges are fair reasonable and transparent etc, total £850.93 there was no mention of account number on my letter, so I called them and was told it was an error and the letter was wrong they were paying £2194.77 if I went into the branch they could fax the department for me so I could accept the correct amount.

    So off I go into my branch explained the whole story and the customer service lady made some calls and advised that the £850 offered in the letter was for my account which I had closed, I was only asking for £650 she said they have given you more as a gesture of good will! so I accepted the £850 and made a point of writing on the letter and ensuring that their computer was updated to what she told me, that this was for the closed account.

    This left me then waiting for the payment and an answer to my second claim which on Friday I got another letter offering me £1904.00 which was a bit short of what I had asked but I thought I would accept it and fax it back.

    I have just called NatWest to confirm they have received my acceptance only to be advised that the letter offering me £1904.00 was an error as they had not realised they had already paid me £850.00 so all I am now getting is £1300.00 can they do this? the letter I got on Friday did not mention any deductions I explained they were two seperate claims, so now they have given me the snr customer relations managers direct line to call him but I woukd like some info before I call can they do this legally?

    It's the right move to report them if they wont give your details you've requested. The Information Commissioner only deals with your request for data. When you receive your details, move onto the next step for reclaiming as normal.

    They will not accept any liability with any offers they make, so they can offer as much or as little as they want. If you don't accept the offer, carry on with your claim. You would likely get the whole amount back if you continue your claim, and refuse this offer.

    I accepted the £1904.00 and faxed it back, that's the problem they now want to pay less after offering and me accpeting
