  • does anyone know if it is quicker to contact the fso or to contact mcol, it will be the last day of my 3rd letter tomorrow and i can't afford to take court action yet! but the bank have also said that i should have an offer by the end of the month, don't know whether to wait, or what..

    I too am in the same position as you i have heard my claim offer letter is on the way and should be with me by the 18th however their 14 days is up by then so im not too sure whether to proceed with mcol or just leave it - i really dont want to not fight them for the charges but i just havent got the money to spare to go through MCOL.

    If iwas you i would try the FO after all its worth a go and if it means not forking out money you havent got then try it - i think i'll be doing the same after once again getting home and finding no response from natwest in the post!!

    I was in the same position so decided to contact FO when natwest had had 6 weeks. I informed the lovely lady at FO that natwest had informed me they would probably not be making an offer before the 8 weeks and by my dates their 8 weeks was almost up. They were REALLY helpful and contacted them on my behalf. I would'nt of called them before the 6 weeks though.

    You can fill out an application onlnine at the FO website or over the phone. Eithier way a quick response is garunteed.

    One of the most scandalous apects of this farce is that NatWest (and I'm sure many other banks) appear to be treating each case in an entirely arbitrary manner, as if they throw a dice to decide how they'll deal with each one as it comes in. Some people roll a '6' and get paid straight away; others of us evidently only threw a '1', so we're being strung along for the longest possible time. It doesn't even appear to be related to amounts: it would seem more logical for a case like mine to be fought for a long time; but then others appear to have claimed as much or more, but to have been paid within a few weeks. Meanwhile, some people only claiming back a few hundred pounds have been kept wating for ages too.

    Now, you would have thought that a professional organisation would have thought, "hmmm, we've got a problem on our hands here, and we don't want to look stupid, so we'll set up a special department to deal with these cases in an equitable and fair manner." However, with each day that passes, it makes you wonder who we've been entrusting our money to all these years, doesn't it?

    Perhaps they're using Spike Milligan's hat - only some of us are put into the draw!

    Can't say I've ever thought of banks as professional organisations - I'm just pleased that we are reclaiming the pounds of flesh and the pints of blood they've taken over the past six years. Not long enough really but better than nowt! I hope your businesses will survive to thrive - keep us posted.

    The one thing that's really pleased me in the whole reclaiming saga of mine is that Nastywest no longer intimidate me. I feel they bullied me for years over their excessive charges which quickly snowballed my debt into a huge cast iron ball and chain round my ankles. I was taken seriously ill 3 and a half years ago with a stress related physical illness which required very major surgery. The year prior to that surgery, the bank was piling on the pressure on me. Work that one out ....
    That's why I'm determined I'll get every last penny of what they owe me, back in my hands.

    Hear, hear, Pam. I too have suffered terribly from bank-induced stress -- though fortunately have not had to endure surgery -- and I've absolutely had it up to the back teeth with banks.

    I'm determined to reach the stage where I can live without them entirely, if need be.

    Spike Milligan's hat -- Lord help us! (But sadly, quite possibly true...)

    Thanks for the kind wishes Kate. You bet my businesses will survive -- and I feel like setting up another one to campaign for more rigorous regulation of the banking industry. I've come to realise that they're all crooks: Cahoot just hiked the rate on my flexible loan with them by 5% up to 19.9%, my Egg card that began at 3.9% is now at 24.9%, A&L is at 27.9%. And I'm a law-abiding citizen with no defaults, no bad debt, no CCjs, no arrears, yet these b*stards make you feel like you've done something to deserve these punitive charges and interest rates.

    The only thing banks produce are gargantuan profits from the sweat and tears of ordinary people. And I, for one, have had enough.

    Incidentally, as well as the advice I've found here and on other sites, I bought a very inspiring set of CDs and workbook by a chap called John Commuta called "Turning debt into wealth." As a result, I've been able to pay off nearly £4,000 of debt in the last six months or so, and aim to have cleared the lot -- well in excess of £70,000, including the mortgage -- within 7 years. Some people might find his approach useful.

    Thanks, Pam.

    John Commuta is an American so, perhaps inevitably, certain aspects of his CDs are a bit 'schmalzy' when he recounts his personal experiences, and some of his investment advice is geared to the US system, so needs to be translated to UK equivalent products. He talks about 'mortgage coupons', for example, which reveals that they do things rather differently across the Pond.

    But the main thrust of the course is extremely good, and he provides ways of calculating which debts to pay off first and why, and excellent motivational pep talks to keep you going even when times get tough.

    I have reclaimed over £460 off the NW. I closed my account 2 years ago there. they took 2 months to come up with the details I needed. I sent 5 letters in all. Sound familiar?

    They have offered £80!!?? I have sent a letter stating no deal, but will accept it as partial settlement, and that I want full settlement in 10 days or I go to court. I have been reasonable and followed timetables... I now await my money!
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....
