    The question now is, how long will it take for NatWest to credit the account, has anyone experienced this?

    How much did you claim?
    Natwest - LBA sent 26/04/07, FO. Sent email to Michael Duncan on 11/05/07. SUCCESS - Offer letter received 19/05/07 for full amount.
    Natwest Credit Card - 1st letter sent 27/4/2007 (£294) SUCCESS - Full amount repaid
    Capital One - 1st Letter 03/2007, FO in Sep 07. SUCCESS full amount repaid Jan 08
  • hi all, I have just spoken with natwest as I wanted to see where in the stages we are with our claim. They told me it is in the offers stage & someone will write to me within 4-6 weeks with an offer!! She alos said that they dont give back interest on what you are claiming, is this correct or are they trying to fiddle me out of nearly 1k? Thanks in advance x

    Do you think they are paying out the 'smaller' claims first? I know of a few people who had an offer and the money in thier account within 3 weeks and thier claims were under £500. Yet all those over £500 seem to be taking a lot longer?

    They told me on the phone this was not the case and that they were working in date order, which i know to be untrue because again i know people who sent letters after me and have had the money already.

    Im getting so frustrated at being on hold for ages then speak to someone who is clearly reading off a sheet!

    There is no way i would wait another 4-6 weeks. Go to the next stage. You have to ask yourself, would they wait if you owed them money?

    I dont think as a rule they pay interest but if you have to go to court im sure you can claim it then.
  • thats what I said o them, that they have till tuesday to respond & She said with the amount of claims they have they are behindbut like you say they wouldnt wait iif I owed them would they? I think I am going to want the whole amount without interest if they wont give it me then go to court & then I can get iterest back aswell if it goes to plan in court, but I am worried that they will throw the case out? tmy toal was £2215.32 with interest & my hubbys was £1704.13 with interest but she came with a figure of £1609 for mine & £1323 for hubby, what do youthink I should do?? thanks

    Saw an article on the BBC News website that I found interesting. (will post the link when I find it). Basically someone has just sucessfully claimed £36000 back from Natwest!!!! They claimed that the court costs would outweigh the settlement. However surely they just need to go to court and win and the cost of being able to stop everyone elses claims would more than cover that one case. To me that just proves that Natwest have no case at all.

    The bank will not admit that they are refunding the charges or interest on them. They will only make an offer as a goodwill gesture. If they accepted liability for charging people unlawfully they would be in big trouble. Thats why they won't take it to court as the court would make the bank disclose all internal financial infrastructure to determine the true cost of the charges and that would mean that all other banks would have full visibility of the other banks financial setups. This would cost the banks millions as they would lose any edge over other banks and would possibly have to then repay millions in unlawful charges.

    Tehy won't therefore admit to paying the interest but it should be part of the offer they make you.

    Either way, I intend taking them to court if they don't offer me exactly what I am claiming.

    They are in the wrong and they know it. They are running scared, otherwise they would not have paid out a single payment to anyone claiming the charges back. In the beginning they paid out left right and centre as it was only a small amount of claims. Now more and more are claiming everyday and costing the bank loads of money in extra staff to process the claims, solicitors fees, etc etc...Thats why they are now trying to stand firm and scare people out of claiming.

    Don't worry about the legal stuff - they send the same thing to everyone. You don't even need to read it. They will ask for more information becasue they say the claim is poor but just send a letter to them and the judge saying this has already been done. (Its on this thread somewhere or I have a copy saved if you can't find it)
    Then its just a case of filling in the Allocation Questionnaire and there are detailed instructions here too.
    The legal stuff is just them trying to intimidate us!
