The bank will not admit that they are refunding the charges or interest on them. They will only make an offer as a goodwill gesture. If they accepted liability for charging people unlawfully they would be in big trouble. Thats why they won't take it to court as the court would make the bank disclose all internal financial infrastructure to determine the true cost of the charges and that would mean that all other banks would have full visibility of the other banks financial setups. This would cost the banks millions as they would lose any edge over other banks and would possibly have to then repay millions in unlawful charges.
Tehy won't therefore admit to paying the interest but it should be part of the offer they make you.
Either way, I intend taking them to court if they don't offer me exactly what I am claiming.
They are in the wrong and they know it. They are running scared, otherwise they would not have paid out a single payment to anyone claiming the charges back. In the beginning they paid out left right and centre as it was only a small amount of claims. Now more and more are claiming everyday and costing the bank loads of money in extra staff to process the claims, solicitors fees, etc etc...Thats why they are now trying to stand firm and scare people out of claiming.
Bring it on NATWEST...

My apologies, I worded it a bit confusingly. I meant that I am personally claiming the charges plus interest from the bank, even prior to court and I know others have too and received the total charges plus interest before going to court.Natwest - LBA sent 26/04/07, FO. Thanks everyone or thier answers, hopefully I iwll get the full amount from them, if not will have to take it to court, but am worried that it will be thrown out, has there been many cases wehre the courts dont want to no?0

That is rubbish. this would have been in the high court so any costs they incurred would have been recoverable from the Claimant had they won. They threw in the towel as they didn't believe the strength of their own case. the response when settling here is a standard non liable response from a lawyer. Then its just a case of filling in the Allocation Questionnaire and there are detailed instructions here too.
The legal stuff is just them trying to intimidate us!

After the hell that bank have put me through with their charges, I thoroughly enjoyed seeing the document, with Natwest cited as the 'Defendant' :rotfl: :j

I have read on these forums that you can claim charges back that are older than the last 6 years. Is this true and if so how would I go about it?
Do I go through the same process or do I need to alter the method slightly?

I am currently in the MCOL stage of my claim against Natwest, although I think I have made a mistake. When adding up my charges they came to over 6000.00 and so on the advice of a someone who had already claimed back their charges, have done this in 2 stages in order to keep the amount under 5000.00. to stay in the small claims court. I also did not claim back any interest on this amount ( 700.00 ) again to stay under 5000.00. I realise now that the threshold is prior to adding interest.
Should I continue with my separate claims, or would it be better to ammend my existing claim and re-serve. Natwest currently have until monday to enter defence on the first claim.
Have also received a cheque this morning in full settlement of claim on separate account for 182.000 -

Personally I would ignore the email and continue with the timetable laid out in this site. Stick to your guns and don't be fooled by their delaying tactics.
And don't be lured into feeling sorry for them having to deal with "all these claims" cause if they had played fairly in the beginning they wouldn't be having these problems now.Natwest - LBA sent 26/04/07, FO.
